authority” is defined in section 21(1) of the Retained EU Law (Revocation and Reform) Act 2023.</p></authorialNote> for the purposes of section 14(2) and (3) of the 2023 Act.</p><p>In accordance with paragraph 5(1) of Schedule 5 to the 2023 Act, a draft of this instrument has been laid before Parliament and approved by a resolution of each House of Parliament.</p></formula></preamble><body><hcontainer name="regulation" eId="regulation-1"><heading>Citation, commencement and extent</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><content><p>These Regulations may be cited as the Controlled Drugs (Drug Precursors) (Amendment and Revocation) Regulations 2026 and come into force 21 days after the day on which they are made.</p></content></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><content><p>Subject to paragraphs (3) and (4), these Regulations extend to England and Wales, Scotland and Northern Ireland.</p></content></paragraph><paragraph eId="regulation-1-3"><num>(3)</num><content><p>Regulations 5 to 8 extend to England and Wales, and Scotland only.</p></content></paragraph><paragraph eId="regulation-1-4"><num>(4)</num><content><p>Regulation 9 and the Schedule extend to Northern Ireland only.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Amendment of the Controlled Drugs (Drug Precursors) (Intra-Community Trade) Regulations 2008</heading><num>2.</num><paragraph eId="regulation-2-1"><num>(1)</num><content><p>The Controlled Drugs (Drug Precursors) (Intra-Community Trade) Regulations 2008<authorialNote class="footnote" eId="f00003" marker="3"><p><ref eId="c00048" href="http://www.legislation.gov.uk/id/uksi/2008/295">S.I. 2008/295</ref>, amended by <ref eId="c00049" href="http://www.legislation.gov.uk/id/uksi/2019/742">S.I. 2019/742</ref> and by section 15(3) of, and paragraph 190 of Schedule 8 to, the Crime and Courts Act <ref eId="c00050" with Articles 20 to 25 of the Community Regulation;</p></content></level><level class="para1"><num>(b)</num><content><p>present the import authorisation obtained in accordance with Article 20 of the Community Regulation to the customs office when the scheduled substances are declared for customs procedure in accordance with Article 22 of the Community Regulation.</p></content></level></paragraph></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para1" eId="regulation-3-6-d"><num>(d)</num><content><p><mod>in paragraph (3) after “paragraph (1)” insert <quotedText>“or paragraph (b), (c) and (e) and (7) and 20(1)(a) of the Retained EU Law (Revocation and Reform) Act <ref eId="c00031" href="http://www.legislation.gov.uk/id/ukpga/2023/28">2023 (c. 28)</ref> (“<term refersTo="#term-the-2023-act">the 2023 Act</term>”). These Regulations revoke, replace and make alternative provision in secondary assimilated law which establish the processes and rules governing the control and trade in drug precursor chemicals in Great Britain, and trade between Great Britain, Northern Ireland and third countries.</p></blockContainer><blockContainer ukl:Name="P"><p>Article 5(4) of the Windsor Framework<authorialNote class="footnote" eId="f00022" marker="22"><p><a href="https://commission.europa.eu/strategy-and-policy/relations-united-kingdom/eu-uk-withdrawal-agreement/windsor-framework_en">https://eur-lex.europa.eu/legal-content/EN/TXT/?toc=OJ%3AL%3A2023%3A102%3ATOC&amp;uri=uriserv%3AOJ.L_.2023.102.01.0087.01.ENG</a></p></authorialNote> provides that EU law listed in Annex 2 will apply to and in the UK in respect of Northern Ireland.  Regulation <ref eId="c00032" href="http://www.legislation.gov.uk/european/regulation/2004/0273">(EC) No 273/2004</ref> of the European Parliament and of the Council of 11 February 2004 on drug precursors and Council Regulation <ref eId="c00033" href="http://www.legislation.gov.uk/european/regulation/2005/0111">(EC) No 111/2005</ref> laying down rules for the monitoring of trade between the Union and third countries in drug precursors are listed in Annex 2 and therefore continue to apply in Northern Ireland as they have effect in EU law.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 2 amends the Controlled Drugs (Drug Precursors) (Intra-Community Trade) Regulations 2008 (<ref eId="c00034" href="http://www.legislation.gov.uk/id/uksi/2008/295">S.I. 2008/295</ref>) to update references to <ref eId="c00035" href="http://www.legislation.gov.uk/european/regulation/2004/0273">Regulation (EC) 273/2004</ref> as it applies in Great Britain as secondary assimilated law within the meaning of sections 5 and 11(2) of the 2023 Act and as it applies in Northern Ireland in accordance with Annex 2 of the Windsor Framework.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 3 amends the Controlled Drugs (Drug Precursors) (Community External Trade) Regulations 2008 (<ref eId="c00036" href="http://www.legislation.gov.uk/id/uksi/2008/296">S.I. 2008/296</ref>) to update references to <ref eId="c00037" href="http://www.legislation.gov.uk/european/regulation/2005/0111">Regulation (EC) 111/2005</ref> as it applies in Great Britain as secondary assimilated law within the meaning of sections 5 and 11(2) of the 2023 Act and as it applies in Northern Ireland in accordance with Annex 2 of the Windsor Framework.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulations 2 and 3 also clarify that the penalty provisions set out in regulation 6 of the Controlled Drugs (Drug Precursors) (Intra-Community Trade) Regulations 2008 and regulation 5 of the Controlled Drugs (Drug Precursors) (Community External Trade) Regulations 2008 apply to “scheduled substances” within the meaning of Article 2(a) of <ref eId="c00038" href="http://www.legislation.gov.uk/european/regulation/2004/0273">Regulation (EC) 273/2004</ref> and Article 2(a) of Regulation <ref eId="c00039" href="http://www.legislation.gov.uk/european/regulation/2005/0111">(EC) 111/2005</ref>.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 4 amends the Controlled Drugs (Drug Precursors) (Intra-Community Trade and Community External Trade) Regulations 2010 (<ref eId="c00040" href="http://www.legislation.gov.uk/id/uksi/2010/2564">S.I. 2010/2564</ref>) to update the references to Regulation <ref eId="c00041" href="http://www.legislation.gov.uk/european/regulation/2004/0273">(EC) No 273/2004</ref> and <ref eId="c00042" href="http://www.legislation.gov.uk/european/regulation/2015/0111">Regulation (EC) 111/2005</ref> and makes provision to exempt the fees that would otherwise be payable in relation to export and import authorisations required for the trade in drug precursor chemicals between Great Britain and Northern Ireland.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulations 5 to 8 amend deficiencies in secondary assimilated law arising from the Windsor Framework, in particular by substituting references to “the United Kingdom” with “Great Britain” to reflect the fact that the legislation applies as secondary assimilated law only in Great Britain. This ensures that the procedures under <ref eId="c00043" href="http://www.legislation.gov.uk/european/regulation/2005/0111">Regulation (EC) 111/2005</ref> will apply to the movement of drug precursor chemicals between Great Britain and Northern Ireland. Regulations 5 and 6 also update outdated definitions and amend the annexes to <ref eId="c00044" href="http://www.legislation.gov.uk/european/regulation/2004/0273">Regulation (EC) 273/2004</ref> and <ref eId="c00045" href="http://www.legislation.gov.uk/european/regulation/2005/0111">Regulation (EC) 111/2005</ref> to control certain drug precursor chemicals in Great Britain, which brings regulated drug precursor chemicals in Great Britain in line with those controlled in Northern Ireland (by the European Union). Regulation 7 also revokes the forms in Annexes II and III to Commission Delegated <ref eId="c00046" href="http://www.legislation.gov.uk/european/regulation/2015/1011">Regulation (EU) 2015/1011</ref> which are no longer used in Great Britain.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 9 revokes the instruments listed in the Schedule in so far as they extend
