The Secretary of State makes this Order in exercise of the powers conferred by section 8(2) of the Immigration Act 1971(1).
1.—(1) This Order may be cited as the Immigration (Exemption from Control) (Amendment) Order 2024 and comes into force on 15th July 2024.
(2) This Order extends to England and Wales, Scotland and Northern Ireland.
2. In Article 4 of the Immigration (Exemption from Control) Order 1972(2), after paragraph (m) insert—
“(ma)the following representatives of the European Union:
(i)the President of the European Commission, being the President of the European Commission referred to in Article 17(6) of the Treaty on European Union signed at Maastricht on 7th February 1992 as it had effect immediately before IP completion day (“Treaty on European Union”);
(ii)the President of the European Council, being the President of the European Council referred to in Article 15(6) of the Treaty on European Union,
(iii)the High Representative for Foreign Affairs, being the High Representative of the Union for Foreign Affairs and Security Policy referred to in Article 18 of the Treaty on European Union;”.

This Order amends the Immigration (Exemption from Control) Order 1972 (“the principal Order”), made under section 8(2) of the Immigration Act 1971 (“the Act”).
Article 4 of the principal Order exempts specified classes of person from the provisions of the Act applicable to those who are not British citizens, except any provision relating to deportation. This Order amends Article 4 of the principal Order to add new specified classes of person, namely those holding the roles of the President of the European Commission, President of the European Council and the High Representative for Foreign Affairs.
1971 c. 77; section 8(2) was amended by paragraph 2 of Schedule 4 to the British Nationality Act 1981 (c. 61).
