The International Waste Shipments (Amendment) Regulations 2024

The Secretary of State makes these Regulations in exercise of the powers conferred by Articles 58(1)(a) and 59a(3)(a) of Regulation (EC) No 1013/2006 of the European Parliament and of the Council of 14 June 2006 on shipments of waste(1).

Citation, commencement and extent

1.—(1) These Regulations may be cited as the International Waste Shipments (Amendment) Regulations 2024.

(2) These Regulations come into force on 1st January 2025.

(3) These Regulations extend to England and Wales and Scotland.

Amendments to Regulation (EC) No 1013/2006

2.  Regulation (EC) No 1013/2006 of the European Parliament and of the Council of 14 June 2006 on shipments of waste is amended in accordance with regulations 3 to 6.

Amendments to Annex 1C

3.  In Annex 1C, in paragraph 25(f), in the second sentence—

(a)for “three” substitute “four”;

(b)for “Y46, Y47 and Y48” substitute “Y46, Y47, Y48 and Y49”.

Amendments to Annex 3

4.—(1) Annex 3 is amended as follows.

(2) In Part 1, omit point (e).

(3) In Part 2, in the table under the heading “Other waste containing metals”, omit the entries for GC010 and GC020.

Amendments to Annex 4

5.—(1) Annex 4 is amended as follows.

(2) In Part 1, for point (c) substitute—

(c)Basel entry A2060 does not apply and OECD entry GG040 in Part 2 of Annex 3 applies instead when appropriate..

(3) In Part 2, in the table, in the text under the heading “Wastes containing principally inorganic constituents, which may contain metals and organic materials”, after the entry Y48 insert—

Y49 Waste electrical and electronic equipment(2).
(note the related entry A1181 in Annex 5 to this Regulation)• not containing and not contaminated with Basel Annex I constituents to an extent that the waste exhibits a Basel Annex III characteristic, and
• in which none of the components (e.g. certain circuit boards, certain display devices) contain or are contaminated with Basel Annex I constituents to an extent that the component exhibits a Basel Annex III characteristic.
Waste components of electrical and electronic equipment (e.g. certain circuit boards, certain display devices) not containing and not contaminated with Basel Annex I constituents to an extent that the waste components exhibit a Basel Annex III characteristic, unless covered by another entry in Basel Annex II or by an entry in Basel Annex IX.
Wastes arising from the processing of waste electrical and electronic equipment or waste components of electrical and electronic equipment (e.g. fractions arising from shredding or dismantling), and not containing and not contaminated with Basel Annex I constituents to an extent that the waste exhibits a Basel Annex III characteristic, unless covered by another entry in Basel Annex II or by an entry in Basel Annex IX..

Amendments to Annex 5

6.—(1) Part 1 of Annex 5 is amended as follows.

(2) In the text in section A1 under the heading “METAL AND METAL BEARING WASTES”, for entry A1180 substitute—

A1181

— Waste electrical and electronic equipment

  • containing or contaminated with cadmium, lead, mercury, organohalogen compounds or other Annex I constituents to an extent that the waste exhibits an Annex III characteristic, or

  • with a component containing or contaminated with Annex I constituents to an extent that the component exhibits an Annex III characteristic, including but not limited to any of the following components:

    • glass from cathode-ray tubes included on list A

    • a battery included on list A

    • a switch, lamp, fluorescent tube or display device backlight which contains mercury

    • a capacitor containing PCBs

    • a component containing asbestos

    • certain circuit boards

    • certain display devices

    • certain plastic components containing a brominated flame retardant.

  • Waste components of electrical and electronic equipment containing or contaminated with Annex I constituents to an extent that the waste components exhibit an Annex III characteristic, unless covered by another entry on list A.

  • Wastes arising from the processing of waste electrical and electronic equipment or waste components of electrical and electronic equipment, and containing or contaminated with Annex I constituents to an extent that the waste exhibits an Annex III characteristic (e.g. fractions arising from shredding or dismantling), unless covered by another entry on list A.

(note the related entry Y49 in Annex 4 to this Regulation).

(3) In list B, in the text in section B1 under the heading “METAL AND METAL BEARING WASTES”, omit entry B1110.

(4) In list B, in the text in section B4 under the heading “WASTES WHICH MAY CONTAIN EITHER INORGANIC OR ORGANIC CONSTITUENTS”, omit entry B4030.

Amendments to Commission Regulation (EC) No 1418/2007

7.  In Commission Regulation (EC) No 1418/2007 of 29 November 2007 concerning the export for recovery of certain waste listed in Annex III or IIIA to Regulation (EC) No 1013/2006 of the European Parliament and of the Council to certain countries to which the OECD Decision on the control of transboundary movements of wastes does not apply(3), the table in the Annex is amended in accordance with the Schedule.

Explanatory Note

(This note is not part of the Regulations)

These Regulations implement changes to the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and their Disposal (adopted on 22nd March 1989) (the “Basel Convention”)(4).

In May 2022, the Conference of the Parties to the Basel Convention adopted decision BC-15/18 by which it amended Annexes II, VIII and IX to the Convention in relation to Waste Electrical and Electronic Equipment (WEEE)(5).

Regulations 3 to 6 amend Regulation (EC) No 1013/2006 as follows. Annex 1C of that regulation is amended by regulation 3 to include a reference to WEEE classified as Y49, which has been added to Annex II to the Basel Convention.

Annex 3 is amended by regulation 4 to remove defunct references to WEEE classified as B1110, which is no longer used in the Basel Convention, and GC010 and GC020, which are also no longer classifications accepted for exports from Great Britain.

Annexes 4 and 5, are amended by regulations 5 and 6 to remove references to A1180, B1110 and B4030, which are no longer used in the Basel Convention, and to remove references to codes GC010 and GC020. References are also added to new codes Y49 and A1181 which have been introduced in the Basel Convention.

Regulation 7 and the Schedule also amend the Annex to Commission Regulation (EC) No 1418/2007 in order to remove defunct references to WEEE classified as B4030, GC010 and GC020.

An impact assessment has not been produced for this instrument as no significant impact on the private or voluntary sector is foreseen.
