The Secretary of State makes the following Regulations in exercise of the powers conferred by section 123A(4) of the Transport Act 2000(1).
In accordance with section 160(2A) of that Act(2), a draft of the instrument was laid before Parliament and approved by a resolution of each House of Parliament.
1.—(1) These Regulations may be cited as the Franchising Schemes (Franchising Authorities) (England) Regulations 2024.
(2) These Regulations come into force on the 22nd day after the day on which they are made.
(3) These Regulations extend to England and Wales.
(4) These Regulations apply to England only.
2. Paragraphs (b) to (g) of section 123A(4) of the Transport Act 2000 (franchising schemes) hereby have effect.

These Regulations bring into effect paragraphs (b) to (g) of section 123A(4) of the Transport Act 2000, such that the types of authorities listed in those paragraphs are included within the meaning of “franchising authority” for the purposes of Part 2 of that Act (local transport).
A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen. An Explanatory Memorandum is published alongside the Regulations at www.legislation.gov.uk.
2000 c. 38. Section 123A was inserted by section 4 of the Bus Services Act 2017 (c. 21) and was amended by paragraph 128 of Schedule 4 to the Levelling-up and Regeneration Act 2023 (c. 55).
Section 160(2A) was inserted by paragraph 22(3) of Schedule 2 to the Bus Services Act 2017 (c. 21). There are other amendments but none is relevant.
