The Secretary of State makes these Regulations in exercise of the power conferred by section 37(1) of the Agriculture Act 2020(1).
The Secretary of State has carried out a consultation in accordance with Article 9 of Regulation (EC) No 178/2002 of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety(2) in relation to the revisions to food law made by these Regulations.
In accordance with section 50(6)(a) of the Agriculture Act 2020, a draft of this instrument has been laid before Parliament and approved by resolution of each House of Parliament.
