The Secretary of State makes these Regulations in exercise of the powers conferred by sections 59, 60(1), and 61(1) of the Town and Country Planning Act 1990(1) and sections 203(3) to (8), 205(6), 206(7), 214, 215 and 252(1) of the Levelling-up and Regeneration Act 2023(2).

1990 c. 8. Section 59 has been amended by paragraph 4 of Schedule 1 to the Growth and Infrastructure Act 2013 (c. 27). There are other amendments which are not relevant to these Regulations.
