These Rules are made by—
(a)the Secretary of State, in exercise of the powers conferred by section 6(2) and (4) of the Transport and Works Act 1992(1), and
(b)the Lord Chancellor, in exercise of the powers conferred by section 9 of the Tribunals and Inquiries Act 1992(2).
In so far as these Rules relate to Wales, they are made with the agreement of the Welsh Ministers(3).
1992 c. 53. Section 9 was amended by the Growth and Infrastructure Act 2013 (c. 27), sections. 2(6), 35(1); S.I. 2013/2143, article 2(b). There are other amendments not relevant to these Rules.
For the requirement for agreement to the exercise of functions in relation to Wales, see article 5(1) of, and Schedule 2 to, the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672) and the entry in Schedule 2 relating to the Transport and Works Act 1992. This function has now been transferred to Welsh Ministers by virtue of the Government of Wales Act 2006 (c. 32).
