The Persistent Organic Pollutants (Amendment) Regulations 2023

The Secretary of State, with the consent of the Scottish Ministers and the Welsh Ministers, makes these Regulations in exercise of the powers conferred by Articles 2A, 15(1) and 18(1) of Regulation (EU) 2019/1021 of the European Parliament and of the Council on persistent organic pollutants (recast)1:

Citation, commencement and extent1.

These regulations may be cited as the Persistent Organic Pollutants (Amendment) Regulations 2023 and come into force on 4th July 2023.

(2)

These regulations extend to England and Wales and Scotland.

Amendment of Regulation (EU) 2019/10212.

(1)

Part A of Annex 1 of Regulation (EU) 2019/1021 of the European Parliament and of the Council on persistent organic pollutants (recast) (Substances listed in the Convention and in the Protocol as well as substances listed only in the Convention) is amended as follows.

(2)

In the entry for perfluorooctanoic acid (PFOA), its salts and PFOA-related compounds, in the 4th column, in point 5(c), for “4 July 2023” substitute “3 December 2025”.

EXPLANATORY NOTE
(This note is not part of the Regulations)

These regulations amend Regulation (EU) 2019/1021 of the European Parliament and of the Council on persistent organic pollutants (recast) (OJ No L 169, 25.6.2019, p 45) to extend the period for which the specific exemption in Annex 1 applicable to perfluorooctanoic acid (PFOA), its salts and PFOA-related compounds for certain personal protective equipment applies.

An impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
