The Secretary of State makes these Regulations in exercise of the powers conferred by paragraph 46 of Schedule 6 to the Sentencing Act 2020(1).

Citation, commencement and extent

1.—(1) These Regulations may be cited as the Youth Rehabilitation Order (Electronic Monitoring Whereabouts Requirement) (Responsible Persons) Regulations 2023 and come into force on 3rd July 2023.

(2) These Regulations extend to England and Wales.

Responsible person for the purposes of paragraph 46 of Schedule 6 to the Sentencing Act 2020

2 .  For the purposes of paragraph 46 of Schedule 6 to the Sentencing Act 2020, the description of the person who may be made responsible for the monitoring of the individuals subject to an electronic whereabouts monitoring requirement is a person who is employed by Capita Business Services Limited, 65 Gresham Street, London, England, ECV2 7NQ (Company Number 02299747).

Explanatory Note

(This note is not part of the Regulations)

Paragraph 46 of Schedule 6 to the Sentencing Act 2020 provides that the person made responsible for the monitoring of individuals under an electronic whereabouts monitoring requirement, must be of a description specified in regulations by the Secretary of State.

Regulation 2 sets out the description of the person who may be made responsible for the monitoring of individuals subject to an electronic whereabouts monitoring requirement as part of their Youth Rehabilitation Order in England and Wales.
