The M5 Motorway (Junctions 1 to 3) (60 Miles Per Hour Speed Limit) Regulations 2022

The Secretary of State makes the following Regulations in exercise of the powers conferred by section 17(2) and (3) of the Road Traffic Regulation Act 19841.

Representative organisations have been consulted in accordance with section 134(2) of that Act.

Citation and commencement1.

These Regulations may be cited as the M5 Motorway (Junctions 1 to 3) (60 Miles Per Hour Speed Limit) Regulations 2022 and come into force on 9th May 2022.

Interpretation2.

In these Regulations—

carriageway”, “central reservation” and “motorway” have the same meaning as in the Motorways Traffic (England and Wales) Regulations 19822;

Cakemore Road bridge” means the bridge carrying the road known as the B4169 over the M5;

the Junction 1 bridge” means the northern bridge of the circulatory intersection at Junction 1 of the M5 know as the West Bromwich Interchange;

the M5” means the motorway known by that name;

off-slip road” means a road intended for the use of traffic exiting the M5;

the Oldbury Interchange” means the circulatory intersection at junction 2 of the M5; and

on-slip road” means a road intended for the use of traffic entering the M5.

60 miles per hour speed limit3.

(1)

No person shall drive a vehicle at a speed exceeding 60 miles per hour on a road, or a specified length of road, referred to in paragraph (2).

(2)

The roads, or specified lengths of road, to which this paragraph refers are—

(a)

that length of the northbound carriageway of the M5 beginning at a point 425 metres south of that point on the central reservation of the M5 immediately below the centre of Cakemore Road bridge (“the southern point”) and ending at a point 132 metres north-east of that point on the central reservation of the M5 immediately below the north-eastern edge of the Junction 1 bridge (“the northern point”);

(b)

that length of the southbound carriageway of the M5 beginning at the northern point and ending at the southern point;

(c)

at junction 1 of the M5—

(i)

the off-slip road on the northbound carriageway; and

(ii)

that length of the on-slip road on the southbound carriageway beginning at a point 13 metres south-west of the junction with the West Bromwich Interchange and ending at the merge with that carriageway; and

(d)

at junction 2 of the M5—

(i)

the off-slip roads on the northbound and southbound carriageways;

(ii)

that length of the on-slip road on the northbound carriageway beginning at a point 36 metres north-east of the junction with the Oldbury Interchange and ending at the merge with that carriageway; and

(iii)

that length of the on-slip road on the southbound carriageway beginning at a point 26 metres south-west of the junction with the Oldbury Interchange and ending at the merge with that carriageway.

EXPLANATORY NOTE
(This note is not part of the Regulations)

These Regulations introduce a fixed speed limit of 60 mph on the M5 motorway between junctions 1 and 3 and on slip roads at junctions 1 and 2.

Contravention of these Regulations is an offence under section 17(4) of the Road Traffic Regulation Act 1984.

An impact assessment has not been prepared for these Regulations as no significant impact on the cost of business or the voluntary sector is foreseen. An Explanatory Memorandum is published alongside the Regulations at www.legislation.gov.uk.
