The Minister for the Civil Service makes these Regulations in exercise of the powers conferred by sections 1(1) and (2)(a), 2 and 3 of the Public Service Pensions Act 2013(1) (“the 2013 Act”).

In accordance with section 3(5) of the 2013 Act, these Regulations are made with the consent of the Treasury.

In accordance with section 21(1)(2) of the 2013 Act, the Minister has consulted representatives of such persons as appear to him likely to be affected by these Regulations.

Citation and commencement

1.—(1) These Regulations may be cited as the Civil Service (Other Crown Servants) Pension Scheme (Amendment) Regulations 2022.

(2) These Regulations come into force on 1st April 2022.

Amendment of the Civil Service (Other Crown Servants) Pension Scheme Regulations 2016

2.—(1) The Civil Service (Other Crown Servants) Pension Scheme Regulations 2016(3) are amended as follows.

(2) In regulation 2 (interpretation), in the definition of “extraordinary members”, after “members of the” insert “Third Connected Scheme or the”.

(3) In regulation 2A(1) (conditions of eligibility for a GCHQ eligible person)—

(a)for sub-paragraph (a) substitute—

(a)P was an active member of one of the following on the protected transfer date—

(i)the First Connected Scheme;

(ii)the Second Connected Scheme;

(iii)the Third Connected Scheme;

(iv)the Fourth Connected Scheme;

(v)this scheme;

(b)in sub-paragraph (b)—

(i)for “continues to be” substitute “is”;

(ii)for “this scheme” substitute “one of the schemes listed in sub-paragraph (a)”.

(4) In regulation 10 (modifications to the 2014 regulations)—

(a)in paragraph (15)(a)(i), after “Second,” insert “Third”;

(b)in paragraph (16)(b), in the modified paragraph 6A(3), for “31st March 2016” substitute “31st March 2022”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Civil Service (Other Crown Servants) Pension Scheme Regulations 2016 (S.I. 2016/326) (“the 2016 Regulations”), primarily in consequence of provision made by the Public Service Pensions and Judicial Offices Act 2022 (c. 7).

The amendments ensure that the existing pension schemes referred to as the First, Second, Third and Fourth Connected Schemes in the 2016 Regulations will be closed to future service accrual on and after 1st April 2022. Any members currently in pensionable service under the First, Second, Third and Fourth Connected pension schemes will, on that date, begin accruing benefits in the scheme established by the 2016 Regulations, with members of the Third Connected Scheme becoming extraordinary members under the 2016 Regulations.

A full impact assessment has not been produced for this instrument.
