The Secretary of State, in exercise of the powers conferred by sections 15(1) and (2), and 82(3)(a) of, and paragraphs 1(4) and 2(1) of Schedule 3 to, the Health and Safety at Work etc. Act 1974(1), following consultation with the Health and Safety Executive, the Office for Nuclear Regulation and such other bodies as appeared to the Secretary of State to be appropriate in accordance with section 50(1AA)(2) of that Act, makes the following Regulations.

Citation and commencement

1.  These Regulations may be cited as the Ammonium Nitrate Materials (High Nitrogen Content) Safety (Amendment) Regulations 2022 and come into force on 4th February 2022.

Amendment of the Ammonium Nitrate Materials (High Nitrogen Content) Safety Regulations 2003

2.—(1) The Ammonium Nitrate Materials (High Nitrogen Content) Safety Regulations 2003(3) are amended as follows.

(2) In regulation 13—

(a)in paragraph (1), omit “from within the European Union, where that material is imported into Great Britain”;

(b)in paragraph (2)—

(i)for “regulation 2(2)(a)” substitute “regulation 2(2)”;

(ii)for “United Kingdom and the European Union” substitute “United Kingdom or the European Union”;

(c)in paragraph (3), after “does not apply” insert “to relevant ammonium nitrate imported into Great Britain from within the European Union”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Ammonium Nitrate Materials (High Nitrogen Content) Safety Regulations 2003 (S.I. 2003/1082). Regulation 2 amends transitional provisions relating to EU Exit, to permit detonation resistance testing of ammonium nitrate imported into Great Britain from countries outside of the European Union to be carried out at competent laboratories based within the UK or the European Union, and to correct minor errors.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
