The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 27B(1), (2)(c), (3) and (5) and 209(1) of the Employment Rights Act 1996(1).

A draft of these Regulations was laid before Parliament in accordance with section 236(3) of the Employment Rights Act 1996(2) and approved by resolution of each House of Parliament.

1996 c. 18. Section 27B was inserted by the Small Business, Enterprise and Employment Act 2015 (c. 26), section 153(1) and (2).

Relevant amendments were made to section 236(3) by the Small Business, Enterprise and Employment Act 2015, section 153(1) and (3) and the Employment Relations Act 1999 (c. 26), section 9 and Schedule 4, Part 3, paragraphs 5 and 42(1) and (3)(a) and (c).
