The Secretary of State, in exercise of the powers conferred by section 153(4) of the Environmental Protection Act 1990(1), makes the following Order:

Citation, extent and commencement

1.  This Order—

(a)may be cited as the Financial Assistance for Environmental Purposes Order 2021;

(b)extends to England and Wales and Northern Ireland; and

(c)comes into force on 27th September 2021.

Variation of section 153(1) of the Environmental Protection Act 1990

2.  In section 153(1)(2) of the Environmental Protection Act 1990 (purposes for which financial assistance may be given), before paragraph (a) insert—

(za)Cenex (Centre of Excellence for Low Carbon and Fuel Cell Technologies) in relation to its activities as respects England and Wales and Northern Ireland;.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order varies section 153(1) of the Environmental Protection Act 1990 so as to enable the Secretary of State, with the consent of the Treasury, to give financial assistance to, or for the purposes of, Cenex (Centre of Excellence for Low Carbon and Fuel Cell Technologies) in relation to its activities in England, Wales and Northern Ireland.

Cenex (Centre of Excellence for Low Carbon and Fuel Cell Technologies) is a non profit company limited by guarantee whose main objects are the preservation, conservation and protection of the environment by promoting the uptake of low carbon and fuel cell technologies in the automotive sector, and working with the Government to meet its targets to reduce carbon from road transportation.

A full impact assessment has not been produced for this instrument, as no, or no significant, impact on the private, voluntary or public sectors is foreseen. The Explanatory Memorandum is available at www.legislation.gov.uk.

1990 c. 43. The relevant functions of the Secretary of State insofar as they are exercisable within the devolved competence were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46). In relation to Wales, the Secretary of State has concurrent powers with the Welsh Ministers (see article 2 of, and the entry relating to the Environmental Protection Act 1990 in Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672) and paragraphs 30 to 32 of Schedule 11 to the Government of Wales Act 2006 (c. 32)).

Section 153(1) is varied by S.I. 1991/682, 1992/654, 1993/1062 and 1518, 1995/150, 554, 1085 and 3099, 1996/505 and 1431, 1997/651, 1998/538, 1001 and 3234, 2000/207 and 2211, 2002/1686 and 2021, 2003/714 and 2119, 2005/1805, 2006/1735, 2007/1671, 2008/3243 and 2009/1506 and by Part 8 of Schedule 5 to the Clean Neighbourhoods and Environment Act 2005 (c. 16). These statutory instruments were repealed by S.I. 2015/479 in relation to England and Wales only. That instrument also substituted section 153(1)(a) to (nn) for section 153(1)(a) to (aaa) in relation to England and Wales only. S.I. 2020/207 inserted section 153(1)(oo) and (pp) in relation to England and Wales only.
