The Technical Education Certificate (England) Regulations 2021

The Secretary of State for Education makes the following Regulations in exercise of the powers conferred by section A3A(2) of the Apprenticeships, Skills, Children and Learning Act 2009(1).

Citation, commencement, extent and application

1.—(1) These Regulations may be cited as the Technical Education Certificate (England) Regulations 2021 and come into force on 2nd August 2021.

(2) These Regulations extend to England and Wales but apply in relation to England only.

Applications for a technical education certificate

2.  An application for a technical education certificate to be issued must be made in writing.

Supply of copies of a technical education certificate

3.  The Secretary of State may supply a copy of a technical education certificate to a person to whom it was issued if that person applies for it in writing.

Fees for issuing or supplying a copy of a technical education certificate

4.—(1) The Secretary of State may charge a fee for issuing a technical education certificate or for supplying a copy of it.

(2) The fee for issuing a technical education certificate must not exceed £25.

(3) The fee for supplying a copy of a technical education certificate must not exceed £30.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations make provision about technical education certificates issued under section A3A of the Apprenticeships, Skills, Children and Learning Act 2009 to persons who have obtained technical education qualifications and completed additional steps towards occupational competence. Regulation 2 requires that applications for technical education certificates are made in writing. Regulation 3 provides that a copy of a technical education certificate may be supplied to the person to whom it was issued if that person applies in writing. Regulation 4 authorises the Secretary of State to charge a fee for issuing a technical education certificate or supplying a copy of it. The maximum fee for issuing a certificate is £25 and the maximum fee for supplying a copy of it is £30.

An impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
