The Secretary of State makes the following Order in exercise of the powers conferred by sections 172(1) and (3) and 197(2) of the Licensing Act 2003(1).

The Secretary of State considers that the celebration period in relation to which this Order is made marks an occasion of exceptional national significance.

The Secretary of State has consulted with such persons as the Secretary of State considers appropriate in accordance with section 172(4) of the Licensing Act 2003.

In accordance with section 197(4)(2) of the Licensing Act 2003, a draft of this instrument has been laid before Parliament, and approved by a resolution of each House of Parliament.

Citation, commencement, interpretation and extent

1.—(1) This Order may be cited as the Licensing Act 2003 (2020 UEFA European Championship Licensing Hours) Order 2021 and comes into force on 10th July 2021.

(2) In this Order—

“the celebration period” means the period from 9:00 a.m. until 11:59 p.m. on 11th July 2021;

“the specified time” means the period beginning with the expiry of the opening hours(3) and ending at 11:15 p.m.

(3) This Order extends to England and Wales.

Licensing hours

2.—(1) Subject to paragraph (3), premises licences and club premises certificates to which paragraph (2) applies have effect during the celebration period as if the specified time were included in the opening hours.

(2) This paragraph applies to premises licences and club premises certificates by virtue of which the opening hours include hours during the celebration period.

(3) In relation to the use of premises for the provision of late night refreshment(4), the opening hours are to be treated by virtue of paragraph (1) as including the specified time if the premises may also be used during that time for—

(a)the sale by retail of alcohol, or

(b)the supply of alcohol by or on behalf of a club to, or to the order of, a member of the club.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order is made under section 172 of the Licensing Act 2003 (c. 17) and marks the occasion of the final match of the 2020 UEFA European Championship on 11th July 2021, which is hosted in the United Kingdom.

This Order provides for a period during which premises licences and club premises certificates have effect as if the specified time were included in the opening hours under the licence or certificate.

Article 1(2) of this Order prescribes the specified time as the period between the end of the premises’ permitted opening hours, under the premises licence or club premises certificate, and 11:15 p.m. on 11th July 2021.

Paragraph (2) of article 2 provides that this Order only applies to licences and certificates which authorise licensable activities to be carried out during the celebration period, being between 9:00 a.m. and 11:59 p.m. on the 11th July 2021.

Paragraph (3) of article 2 permits premises to be used for the provision of late night refreshment at the specified time only if during that time the premises may also be used for the sale or supply of alcohol.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.

Amendments have been made to section 197 of the Licensing Act 2003 (c. 17) which are not relevant to this Order.
