these Regulations—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term id="term-the-act">the Act</Term>” means the Space Industry Act 2018 and a reference to a section without more is a reference to a section of the Act;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-accident">accident</Term>” includes any fortuitous or unexpected event by which the safety of any launch vehicle or person is threatened, and “<Term id="term-spaceflight-accident">spaceflight accident</Term>” means an accident—</Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text>arising out of, or in the course of, spaceflight activities, and</Text></Para></ListItem><ListItem><Para><Text>occurring—</Text><OrderedList Decoration="parens" Type="roman"><ListItem><Para><Text>in or over the United Kingdom, or</Text></Para></ListItem><ListItem><Para><Text>elsewhere, if any of the circumstances referred to in regulation 16 of the Spaceflight Activities (Investigation of Spaceflight Accidents) Regulations 2021<FootnoteRef Ref="f00003"/> apply;</Text></Para></ListItem></OrderedList></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text>“<Term id="term-accountable-manager">accountable manager</Term>” means the individual appointed under regulation <InternalLink Ref="regulation-7-1-a" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/7/1/a" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/7/1/a">7(1)(a)</InternalLink>, <InternalLink Ref="regulation-8-1" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/8/1" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/8/1">8(1)</InternalLink> or <InternalLink Ref="regulation-11-1-c" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/11/1/c" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/11/1/c">11(1)(c)</InternalLink>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-aerodrome-certificate">aerodrome certificate</Term>” means a certificate issued under the Aerodromes Regulation;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-aerodromes-regulation">Aerodromes Regulation</Term>” means <Citation URI="http://www.legislation.gov.uk/european/regulation/2014/0139" id="c00001" Class="EuropeanUnionRegulation" Year="2014" Number="0139">Commission Regulation (EU) No. 139/2014</Citation> of 12th February 2014 laying down requirements and administrative procedures related to aerodromes pursuant to Regulation (EU) 2018/1139 of the European Parliament and of the Council;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-aircrew-regulation">Aircrew Regulation</Term>” means <Citation URI="http://www.legislation.gov.uk/european/regulation/2011/1178" id="c00002" Class="EuropeanUnionRegulation" Year="2011" Number="1178">Commission Regulation (EU) No. 1178/2011</Citation> of 3rd November 2011 laying down technical requirements and administrative procedures related to civil aviation aircrew pursuant to Regulation <Citation URI="http://www.legislation.gov.uk/european/regulation/2008/0216" id="c00003" Class="EuropeanUnionRegulation" Year="2008" Number="0216">(EC) No. 216/2008</Citation> of the European Parliament and of the Council;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-air-traffic-controller">air traffic controller</Term>” means an individual acting as an air traffic controller in pursuance of a licence granted under or by virtue of an enactment;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-blast-overpressure">blast overpressure</Term>” means pressure above normal atmospheric pressure as the result of a shock wave caused by an explosion or detonation;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-caa-licensed">CAA licensed</Term>” in relation to an aerodrome means an aerodrome which is licensed under an Air Navigation Order<FootnoteRef Ref="f00004"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-cabin-crew">cabin crew</Term>” means individuals who take part in spaceflight activities on board a launch vehicle to perform duties assigned by the spaceflight operator or the pilot in command of the launch vehicle, but who are not members of the flight crew;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-carrier-aircraft">carrier aircraft</Term>” means an aircraft which is carrying a launch vehicle which is to separate from that aircraft before the aircraft lands, except in—</Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text>regulations <InternalLink Ref="regulation-2-2-b" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/2/2/b" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/2/2/b">2(2)(b)</InternalLink>, <InternalLink Ref="regulation-15" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/15" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/15">15</InternalLink>, <InternalLink Ref="regulation-27-2-d" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/27/2/d" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/27/2/d">27(2)(d)</InternalLink>, <InternalLink Ref="regulation-36-6-c" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/36/6/c" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/161">161</InternalLink>,</Text></Para></ListItem><ListItem><Para><Text>Parts 9, 11 and 14, and</Text></Para></ListItem><ListItem><Para><Text>paragraph <InternalLink Ref="schedule-1-paragraph-4-c" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/schedule/1/paragraph/4/c" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/schedule/1/paragraph/4/c">4(c)</InternalLink> of Schedule 1, paragraph 12 of Schedule 5, and paragraph 6 of Schedule 8;</Text></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text>“<Term id="term-certified">certified</Term>” in relation to an aerodrome means an aerodrome in respect of which an aerodrome certificate is in force;</Text></Para></ListItem><ListItem><Para><Text>“crew”, except in Part 9, means—</Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text>members of the cabin crew, and</Text></Para></ListItem><ListItem><Para><Text>members of the flight crew;</Text></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text>“<Term id="term-current-risk-assessment">current risk assessment</Term>” means—</Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text>if the risk assessment has not been revised and accepted by the regulator in accordance with regulations <InternalLink Ref="regulation-80" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/80" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/80">80</InternalLink> and <InternalLink Ref="regulation-82" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/82" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/82">82</InternalLink>, the risk assessment, or</Text></Para></ListItem><ListItem><Para><Text>if the risk assessment has been revised and accepted by the regulator in accordance with regulations <InternalLink Ref="regulation-80" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/80" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/80">80</InternalLink> and <InternalLink Ref="regulation-82" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/82" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/82">82</InternalLink>, that revised risk assessment;</Text></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text>“<Term id="term-dangerous-goods">dangerous goods</Term>” means any article or substance which is identified as such in the 2021-2022 English language edition of the Technical Instructions for the Safe Transport of Dangerous Goods by Air<FootnoteRef Ref="f00005"/>, approved and published by decision of the Council of the International Civil Aviation Authority but does not include propellants or other substances necessary for the normal functioning of the launch vehicle;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-day">day</Term>” means a calendar day;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-designated-range">designated range</Term>” means the range identified by the licensee pursuant to regulation <InternalLink Ref="regulation-46-1" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/46/1" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/46/1">46(1)</InternalLink> in respect of the operator’s spaceflight activities;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-emergency-services">emergency services</Term>” means—</Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text>police, fire, rescue and ambulance services, and</Text></Para></ListItem><ListItem><Para><Text>Her Majesty’s Coastguard;</Text></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text>“<Term id="term-flight-crew">flight crew</Term>” means individuals who take part in spaceflight activities on board a launch vehicle as a pilot or flight engineer of the launch vehicle;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-flight-envelope">flight envelope</Term>” means the expected set of trajectories of the launch vehicle taking account of variations to those trajectories and any deviation from those trajectories within which the operator’s spaceflight activities can be carried out safely;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-flight-safety-system">flight safety system</Term>” means a system, including all hardware and software, that provides a controlled means of ending the flight of a launch vehicle for the purposes of ensuring that the operator’s spaceflight activities are carried out safely;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-flight-termination-personnel">flight termination personnel</Term>” means the persons who are not on board the launch vehicle and operate, or oversee the operation of, a flight safety system which is not an autonomous flight safety system;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-fragmentation-debris">fragmentation debris</Term>” means debris that is emitted as a result of an explosion or deflagration;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-ground-control-at-the-spaceport-or-other-place">ground control at the spaceport or other place</Term>” means a site at a spaceport<FootnoteRef Ref="f00006"/> or other place from which spaceflight activities are controlled or are to be controlled but does not include a mission management facility;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-ground-support-equipment">ground support equipment</Term>” means equipment including any hardware and software which is used on the ground or other place to assemble, integrate, test, transport, access, handle, maintain, calibrate, verify, protect or service a launch vehicle;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-hazardous-material">hazardous material</Term>” includes any propellant, whether solid, liquid or gas, any radioactive material or any substance or material prescribed as a hazardous substance for the purposes of the Planning (Hazardous Substances) Act 1990<FootnoteRef Ref="f00007"/>, the Planning (Hazardous Substances) (Scotland) Act 1997<FootnoteRef Ref="f00008"/> or the Planning Act (Northern Ireland) 2011<FootnoteRef Ref="f00009"/> by regulations made under those Acts<FootnoteRef Ref="f00010"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-hazardous-material-storage-facility">hazardous material storage facility</Term>” has the meaning given in regulation <InternalLink Ref="regulation-158-1" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/158/1" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/158/1">158(1)</InternalLink>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-hazardous-pre-flight-and-post-flight-operations">hazardous pre-flight and post-flight operations</Term>” means any operation or activity at a spaceport, the carrying out of which involves a risk to any person from blast overpressure, fragmentation debris, thermal radiation or toxic release;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-her-majestys-forces">Her Majesty’s forces</Term>” has the same meaning as in the Armed Forces Act 2006<FootnoteRef Ref="f00011"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-horizontal-spaceport">horizontal spaceport</Term>” means a spaceport from which spaceflight activities requiring the use of a runway may be carried out by virtue of a spaceport licence<FootnoteRef Ref="f00012"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-human-factors">human factors</Term>” means the human and individual capabilities, characteristics and limitations which influence behaviour or the performance of tasks in a way which may affect the safety of licensed activities;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-human-occupant">human occupant</Term>” means a member of the crew or a spaceflight participant;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-intelligence-service">intelligence service</Term>” means—</Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text>the Security Service;</Text></Para></ListItem><ListItem><Para><Text>the Secret Intelligence Service;</Text></Para></ListItem><ListItem><Para><Text>the Government Communications Headquarters;</Text></Para></ListItem><ListItem><Para><Text>any part of Her Majesty’s forces, or of the Ministry of Defence, which engages in intelligence activities;</Text></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text>“<Term id="term-investigator-in-charge">investigator-in-charge</Term>” means an individual charged, on the basis of the individual’s qualifications, with responsibility for the organisation, conduct and control of a safety investigation;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-launch-director">launch director</Term>” means the individual appointed by the holder of a launch operator licence under regulation <InternalLink Ref="regulation-9-3-a" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/9/3/a" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/9/3/a">9(3)(a)</InternalLink>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-launch-operator-licence">launch operator licence</Term>” means an operator licence<FootnoteRef Ref="f00013"/> which authorises a person to carry out spaceflight activities that include launching a launch vehicle or launching a carrier aircraft and a launch vehicle;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-launch-operator-licensee">launch operator licensee</Term>” means the holder of a launch operator licence;</Text></Para></ListItem><ListItem><Para><Text>“launch vehicle”, other than in references to a “US launch vehicle”, means—</Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text>a craft to which section 1(5) applies and the component parts of that craft, or</Text></Para></ListItem><ListItem><Para><Text>a space object<FootnoteRef Ref="f00014"/> which is a vehicle and the component parts of that vehicle,</Text></Para></ListItem></OrderedList><Text>that is used for the purpose of the proposed spaceflight activities or the operator’s spaceflight activities, as applicable, but does not include a payload carried by the launch vehicle;</Text></Para></ListItem><ListItem><Para><Text>“licensed activities”, except in Parts 5 and 10 and in Schedule 4, means the activities which a person is authorised to carry out by virtue of an operator licence, a spaceport licence or a range control licence<FootnoteRef Ref="f00015"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-licensee">licensee</Term>” means the holder of an operator licence, a spaceport licence or a range control licence under the Act, except in—</Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text>the defined terms—</Text><OrderedList Decoration="parens" Type="roman"><ListItem><Para><Text>“launch operator licensee”,</Text></Para></ListItem><ListItem><Para><Text>“proposed spaceport licensee”,</Text></Para></ListItem><ListItem><Para><Text>“range control licensee”,</Text></Para></ListItem><ListItem><Para><Text>“return operator licensee”,</Text></Para></ListItem><ListItem><Para><Text>“spaceport licensee”, and</Text></Para></ListItem><ListItem><Para><Text>“US licensee”,</Text></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text>Parts 6 and 7, and</Text></Para></ListItem><ListItem><Para><Text>Schedule 4;</Text></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text>“<Term id="term-major-accident">major accident</Term>” means—</Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text>for the purposes of Parts 4, 8, Schedule 1 and Schedule 4 in so far as it relates to a spaceflight operator, an accident arising out of, or in the course of, spaceflight activities or preparation for spaceflight activities that is highly likely to—</Text><OrderedList Decoration="parens" Type="roman"><ListItem><Para><Text>cause death or serious injury to, or</Text></Para></ListItem><ListItem><Para><Text>destroy or seriously damage the property of,</Text></Para></ListItem></OrderedList><Text>persons who are not human occupants;</Text></Para></ListItem><ListItem><Para><Text>for the purposes of Parts 5 and 10, regulation <InternalLink Ref="regulation-181-2-e" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/181/2/e" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/181/2/e">181(2)(e)</InternalLink> and Schedule 4 in so far as it relates to a spaceport licensee, an accident at the spaceport that is highly likely to—</Text><OrderedList Decoration="parens" Type="roman"><ListItem><Para><Text>cause death or serious injury to any person, or</Text></Para></ListItem><ListItem><Para><Text>destroy or seriously damage the property of members of the public;</Text></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text>for the purposes of Part 16, an accident of the types referred to in paragraphs (a) or (b) as appropriate;</Text></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text>“<Term id="term-major-accident-hazard">major accident hazard</Term>” means a hazard that could cause a major accident;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-malfunctions">malfunctions</Term>” means the launch vehicle deviates from operating within its flight envelope or otherwise ceases to operate normally and “<Term id="term-malfunction">malfunction</Term>” means the deviation of such a vehicle from that envelope;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-nasp">NASP</Term>” means National Aviation Security Programme<FootnoteRef Ref="f00016"/>;</Text></Para></ListItem><ListItem><Para><Text>“occurrence”, other than in Part 11, has the meaning given in regulation <InternalLink Ref="regulation-270" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/270" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/270">270</InternalLink>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-occurrence-report">occurrence report</Term>” means a report referred to in regulation <InternalLink Ref="regulation-271-1" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/271/1" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/271/1">271(1)</InternalLink>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-operator">operator</Term>” means the holder of an operator licence;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-operator-security-programme">operator security programme</Term>” means the programme specified in regulation <InternalLink Ref="regulation-171-1" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/171/1" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/171/1">171(1)</InternalLink>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-operators-spaceflight-activities">operator’s spaceflight activities</Term>” means spaceflight activities which are authorised by an operator licence and which are any of—</Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text>launching<Character Name="NonBreakingSpace"/>a launch vehicle;</Text></Para></ListItem><ListItem><Para><Text>launching a carrier aircraft;</Text></Para></ListItem><ListItem><Para><Text>operating the launch vehicle or a carrier aircraft whose launch is authorised by the operator licence, in so far as necessary for one or more of the following assignments—</Text><OrderedList Decoration="parens" Type="roman"><ListItem><Para><Text>to carry a spaceflight participant,</Text></Para></ListItem><ListItem><Para><Text>to carry a payload until its release or separation from the launch vehicle,</Text></Para></ListItem><ListItem><Para><Text>to carry out sub-orbital activities, or</Text></Para></ListItem><ListItem><Para><Text>to return to earth and complete its flight,</Text></Para></ListItem></OrderedList><Text>including orbital activities only in so far as they are necessary to complete such an assignment;</Text></Para></ListItem><ListItem><Para><Text>operating a launch vehicle whose launch is not authorised by the operator licence, in order to cause that vehicle to land in the United Kingdom;</Text></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text>“<Term id="term-orbital-activities">orbital activities</Term>” means spaceflight activities using a launch vehicle which has reached a stable orbit;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-pilot-in-command">pilot in command</Term>” means the pilot who—</Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text>takes part in the operator’s spaceflight activities on board the launch vehicle, and</Text></Para></ListItem><ListItem><Para><Text>is designated by the spaceflight operator as being in command and charged with the safe conduct of its flight, without being under the direction of any other pilot;</Text></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text>“<Term id="term-proposed-spaceflight-activities">proposed spaceflight activities</Term>” means any of the spaceflight activities mentioned in paragraphs (a) to (d) of the definition of “operator’s spaceflight activities” which would be authorised by the operator licence that the applicant is applying for, if granted;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-qualifying-health-and-safety-authority">qualifying health and safety authority</Term>” has the meaning given in section 21(2);</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-range-control-licensee">range control licensee</Term>” means the holder of a range control licence;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-range-operations-manager">range operations manager</Term>” means the individual appointed under regulation <InternalLink Ref="regulation-11-1-b" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/11/1/b" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/11/1/b">11(1)(b)</InternalLink>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-range-safety-manager">range safety manager</Term>” means the individual appointed under regulation <InternalLink Ref="regulation-11-1-a" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/11/1/a" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/11/1/a">11(1)(a)</InternalLink>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-remote-pilot">remote pilot</Term>” means an individual who—</Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text>has the ability to control, in real time, the flight path of the launch vehicle, and</Text></Para></ListItem><ListItem><Para><Text>is not on board that launch vehicle;</Text></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text>“<Term id="term-return-operator-licence">return operator licence</Term>” means an operator licence which is not a launch operator licence and which authorises a person to operate a launch vehicle, launched elsewhere than the United Kingdom, in order to cause that vehicle to land in the United Kingdom;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-return-operator-licensee">return operator licensee</Term>” means the holder of a return operator licence;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-safety-investigation">safety investigation</Term>” means a process conducted by SAIA, or other relevant national or international body, for the purposes of spaceflight accident prevention, which—</Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text>includes the gathering and analysis of information,</Text></Para></ListItem><ListItem><Para><Text>the drawing of conclusions, including the determination of causes and contributing factors, and</Text></Para></ListItem><ListItem><Para><Text>when appropriate, the making of safety recommendations;</Text></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text>“safety management system” in respect of a spaceflight operator and a spaceport licensee is to be construed in accordance with Schedule 4;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-safety-manager">safety manager</Term>” means the individual appointed under regulation <InternalLink Ref="regulation-7-1-b" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/7/1/b" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/7/1/b">7(1)(b)</InternalLink> or <InternalLink Ref="regulation-9-1" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/9/1" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/9/1">9(1)</InternalLink>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-safety-recommendation">safety recommendation</Term>” means a proposal of SAIA, based on information derived from a safety investigation or other sources such as safety studies, made with the intention of preventing spaceflight accidents;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-saia">SAIA</Term>” means the space accident investigation authority nominated by the Secretary of State under regulation 5 of the Spaceflight Activities (Investigation of Spaceflight Accidents) Regulations 2021;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-security-manager">security manager</Term>” means the individual appointed under regulation <InternalLink Ref="regulation-7-1-c" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/7/1/c" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/7/1/c">7(1)(c)</InternalLink>, <InternalLink Ref="regulation-9-3-c" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/9/3/c" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/9/3/c">9(3)(c)</InternalLink>, <InternalLink Ref="regulation-10-2" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/10/2" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/10/2">10(2)</InternalLink> or <InternalLink Ref="regulation-11-1-d" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/11/1/d" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/11/1/d">11(1)(d)</InternalLink>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-ship">ship</Term>” means every description of vessel whether or not used in navigation;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-spaceflight-operator">spaceflight operator</Term>” means the holder of a launch operator licence or a return operator licence;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-spaceflight-participant">spaceflight participant</Term>” means an individual, other than a member of the crew, who is to be carried on board a launch vehicle with the spaceflight operator’s permission;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-spaceport-licensee">spaceport licensee</Term>” means the holder of a spaceport licence;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-space-site-security-programme">space site security programme</Term>” means the programme specified in regulation <InternalLink Ref="regulation-170-1" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/170/1" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/170/1">170(1)</InternalLink>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-stable-orbit">stable orbit</Term>” means an orbit where a launch vehicle—</Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text>has started to travel in an orbit of a minimum perigee of 130 kilometres taking account of any natural influences such as the forces of drag acting on that vehicle, and</Text></Para></ListItem><ListItem><Para><Text>is capable of continuing to travel in that orbit for at least one orbit of the earth;</Text></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text>“technical requirements”, except in the definition of “Aircrew Regulation” and in paragraph <InternalLink Ref="schedule-1-paragraph-11" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/schedule/1/paragraph/11" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/schedule/1/paragraph/11">11</InternalLink> of Schedule 1, means the requirements described in the current safety case as required by paragraph <InternalLink Ref="schedule-1-paragraph-11" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/schedule/1/paragraph/11" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/schedule/1/paragraph/11">11</InternalLink> of Schedule 1;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-technology-safeguards-agreement">Technology Safeguards Agreement</Term>” means the Agreement between the Government of the United States of America and the Government of the United Kingdom of Great Britain and Northern Ireland on technology safeguards associated with United States’ participation in space launches from the United Kingdom entered into on 16th June 2020<FootnoteRef Ref="f00017"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-thermal-radiation">thermal radiation</Term>” means energy emitted as electromagnetic radiation caused by an explosion or deflagration that can be experienced as light or heat;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-toxic-release">toxic release</Term>” means the release of a substance that is toxic to humans;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-training-manager">training manager</Term>” means the individual appointed under regulation <InternalLink Ref="regulation-9-3-b" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/9/3/b" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/9/3/b">9(3)(b)</InternalLink> or <InternalLink Ref="regulation-11-1-e" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/11/1/e" DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/11/1/e">11(1)(e)</InternalLink>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-us-technical-data">US technical data</Term>” has the meaning given in the Technology Safeguards Agreement.</Text></Para></ListItem></UnorderedList></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/2/2" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/2/2" id="regulation-2-2"><Pnumber>2</Pnumber><P2para><Text>For the purposes of these Regulations references to “space site” are to be treated as if they include references to a ship—</Text><P3 to be landed,</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2021/792/regulation/2/2/c" IdURI="http://www.legislation.gov.uk/id/uksi/2021/792/regulation/2/2/c" id="regulation-2-2-c"><Pnumber>c</Pnumber><P3para><Text>from which spaceflight activities are controlled or are to be controlled,</Text></P3para></P3><P3
