Amendment of article 22 (duty to respond to consultation)10.
(1)
Article 22 is amended in accordance with paragraphs (2) and (3).

“(3)
Subject to paragraph (6) the period prescribed for the purposes of section 54(4) of the 2004 Act is—
(a)
the period of 21 days beginning with the day on which—
(i)
the document on which the views of the consultee are sought is received by the consultee, or
(ii)
where there is more than one such document and they are sent on different days, the last of those documents is received by the consultee, or
(b)
such other period as may be agreed in writing between the consultee and the consultor.”.

In the case of an application for public service infrastructure development, where the requirements to consult contained in paragraph (1)(a), (b), (c), (h) or (i) apply, the prescribed period of 21 days in paragraph (3) is to be read as if it were a reference to 18 days.”.
