The Air Navigation (Restriction of Flying) (Belavia) Regulations 2021

The Secretary of State for a reason affecting the public interest deems it necessary to restrict flying in the area specified in regulation 2 by aircraft operating scheduled services by or on behalf of Belavia Belarusian Airlines.

The Secretary of State makes the following Regulations in exercise of the powers conferred by article 239 of the Air Navigation Order 20161.

Citation and commencement1.

These Regulations may be cited as the Air Navigation (Restriction of Flying) (Belavia) Regulations 2021 and they come into force the day after they are made.

Restricted airspace2.

(1)

Subject to paragraph (2), no aircraft operating a scheduled service by or on behalf of Belavia Belarusian Airlines shall fly in the airspace above the United Kingdom or above the territorial sea of the United Kingdom 2.

(2)

Paragraph (1) does not apply to any aircraft flying in accordance with the permission of—

(a)

the Secretary of State, or

(b)

the air traffic control unit at Swanwick or Prestwick.

EXPLANATORY NOTE
(This note is not part of the Regulations)

These Regulations impose restrictions of an emergency nature on flying in the airspace above the United Kingdom or its territorial sea, by aircraft operating scheduled services by or on behalf of Belavia Belarusian Airlines. They are intended to be of temporary duration and will be revoked as soon as it is deemed appropriate to do so.
