These Regulations amend the Town and Country Planning (Control of Advertisements) (England) Regulations 2007 (“the principal Regulations”) (S.I. 2007/783).
Regulation 3 inserts a new Part 4A into the principal Regulations.
The inserted regulation 21A grants permission for a flagstaff to display two flags simultaneously, of which both may be from Class H in Schedule 1 to the principal Regulations or of which one may be from Class H in Schedule 1 to the principal Regulations and the other from Class 7 in Schedule 3 to those Regulations.
The inserted regulation 21B provides that where a flag from Schedule 1 is displayed in conjunction with a flag from Schedule 3, the flag from Schedule 1 must be flown in a superior position to that from Schedule 3. The regulation also provides that where one of the flags flown is the Union flag, that flag must be flown in a superior position to the other flag and that not more than one flag from Schedule 3 may be displayed.
Regulation 4 provides for the omission of the flag of the European Union from the list of flags mentioned in Class H in Schedule 1 to the principal Regulations.
Regulation 5 amends the list of flags set out in each of paragraphs 7A(1), 7AA(1) and 7AB(1) in Class 7 of Schedule 3 to the principal Regulations to provide for the inclusion of a flag bearing the device of the NHS.
Regulation 6 makes consequential amendments to regulation 1(3), regulation 6(1), Class H in Schedule 1 and Class 7 in Schedule 3 to the principal Regulations.
An impact assessment has not been prepared for this instrument as no impact on the costs of business or the voluntary sector is foreseen.
