					<dc:description>This Order, made on the application of Weymouth and Portland Borough Council (now Dorset Council) modernises and consolidates the statutory harbour powers applying in relation to Weymouth Harbour and provides for:The Jurisdiction (article 4) and General functions (article 5) of the Council as the statutory harbour authority for Weymouth Harbour and clarity on the limits of the harbour (article 6) including plans of the harbour limits and the harbour premises which can be inspected during working hours at the office of the Marine Management Organisation, Lancaster House, Hampshire Court, Newcastle upon Tyne, NE4 7YH and the principal office of the Dorset Council County Hall, Colliton Park, Dorchester, Dorset, DT1 1XJ.Powers to vest in the Council relating to finances including application (article 7), reserve fund (article 8) and borrowing powers (article 9).A modern suite of charging powers (article 10 – 19) including exemptions from harbour dues (article 17) and prevention of sailing of vessels (article 19).Powers of general and special direction on the Council and the harbour master (defined in article 2) for the regulation and management of the harbour (articles 20 to 27). A register of all in force general directions which may be inspected during working hours at the harbour office of the Council (article 23). This Order creates an offence of failing to comply with special or general directions, the penalty for which is a fine on summary conviction not exceeding level 4 on the standard scale (article 25). A defence of due diligence is available to a person charged under article 25 (article 25(2)).The establishment of an advisory body consisting of harbour stakeholders with which the Council are required to consult on material matters (article 28).Powers relating to development of land (article 29), power to grant tenancies and dispose of land (article 30), power to appropriate lands and works for particular uses, etc. (article 31), other commercial activities (article 32), power to delegate functions (article 33).Powers relating to moorings (article 34), bunkering (article 35), aids to navigation (article 36), power to dredge (article 37), repairing of landing places (article 38).Powers relating to disposal of wrecks (article 39), unserviceable vessels (article 40), removal of obstructions other than vessels (article 41) and notices (article 43).Savings for Trinity House (article 42), the Crown (article 44) and existing byelaws etc. (article 45).To facilitate that above, the Order repeals and revokes the Acts and Orders set out in Schedule 2 to the Order and amends the Acts of 1854, 1879, 1887, 1914 and Orders of 1930 and 1988 as set out in article 46.</dc:description>

ashore</Addition></Term><Addition ChangeId="key-7203e300ec8fad6cd23d403f75666dd9-1773946208993" CommentaryRef="key-7203e300ec8fad6cd23d403f75666dd9">”   means all those parts of the harbour not within the wet harbour area;</Addition></Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-the-council">the Council</Term>” means Dorset Council;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-charges">charges</Term>” means the charges, rates, tolls and dues which the Council is for the time being authorised to demand, take and recover in relation to the harbour undertaking;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-commercial-refuelling-activities">commercial refuelling activities</Term>” means recharging or emptying (in whole or part) a vessel with fuel in exchange for financial payment or other valuable consideration;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-electronic-communications-network">electronic communications network</Term>” has the meanings given by section 32 to the Communications Act 2003<FootnoteRef Ref="f00016"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-functions">functions</Term>” means the powers and duties at and in connection with the harbour authorised by this Order and the Acts and Orders listed in Schedule 3 (to the extent that those Acts and Orders relate to the harbour);</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-general-direction">general direction</Term>” means a direction given under article 21 of this Order;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-the-harbour">the harbour</Term>” means the harbour of Weymouth the limits of which include the harbour premises and are defined in article 6 of this Order;</Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="key-7203e300ec8fad6cd23d403f75666dd9-1773944376277" CommentaryRef="key-7203e300ec8fad6cd23d403f75666dd9">“the Harbour Advisory Group”   means the body or bodies established in accordance with article 28 (advisory bodies);</Addition></Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-harbour-facilities">harbour facilities</Term>”means shipping, fisheries, marine, recreational, leisure, tourism and retail facilities (including buildings).</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-harbour-limits-plan">harbour limits plan</Term>” means the plan prepared in duplicate, signed on behalf of the Marine Management Organisation and marked “Signed plan referred to in the Weymouth Harbour Revision Order 2021”, one copy of which is deposited at the offices of the Marine Management Organisation <FootnoteRef Ref="f00017"/> and the other at the principal office of the Council<FootnoteRef Ref="f00018"/>.</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-the-harbour-master">the harbour master</Term>” means any person appointed as such by the Council, and includes the duly authorised deputies and assistants of the harbour master and any other person for the time being authorised by the Council to act, either generally or for a specific purpose, in the capacity of harbour master;</Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="key-7203e300ec8fad6cd23d403f75666dd9-1773927458904" CommentaryRef="key-7203e300ec8fad6cd23d403f75666dd9">“harbour operations” include—</Addition></Text><OrderedList Type="alpha" Decoration="parens"><ListItem><Para><Text><Addition ChangeId="key-7203e300ec8fad6cd23d403f75666dd9-1773927458904" CommentaryRef="key-7203e300ec8fad6cd23d403f75666dd9"> include the marking, lighting or dredging of the harbour or any part of the harbour;</Addition></Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="key-7203e300ec8fad6cd23d403f75666dd9-1773927458904" CommentaryRef="key-7203e300ec8fad6cd23d403f75666dd9">the berthing, mooring, storage or dry docking of a vessel;</Addition></Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="key-7203e300ec8fad6cd23d403f75666dd9-1773927458904" CommentaryRef="key-7203e300ec8fad6cd23d403f75666dd9">the laying and maintenance of moorings or other similar apparatus in the harbour;</Addition></Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="key-7203e300ec8fad6cd23d403f75666dd9-1773927458904" CommentaryRef="key-7203e300ec8fad6cd23d403f75666dd9">the warehousing, sorting, weighing or handling of goods;</Addition></Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="key-7203e300ec8fad6cd23d403f75666dd9-1773927458904" CommentaryRef="key-7203e300ec8fad6cd23d403f75666dd9">the movement of goods and vehicles (including parking, designated and prohibited areas, speed limits and removal from the harbour);</Addition></Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="key-7203e300ec8fad6cd23d403f75666dd9-1773927458904" CommentaryRef="key-7203e300ec8fad6cd23d403f75666dd9">the towing, or moving of a vessel;</Addition></Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="key-7203e300ec8fad6cd23d403f75666dd9-1773927458904" CommentaryRef="key-7203e300ec8fad6cd23d403f75666dd9">the loading or unloading of goods, or embarking or disembarking of passengers;</Addition></Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="key-7203e300ec8fad6cd23d403f75666dd9-1773927458904" CommentaryRef="key-7203e300ec8fad6cd23d403f75666dd9">energy generation or storage;</Addition></Text></Para></ListItem><ListItem><Para><Text><Addition ChangeId="key-7203e300ec8fad6cd23d403f75666dd9-1773927458904" CommentaryRef="key-7203e300ec8fad6cd23d403f75666dd9">the control of use of the harbour by members of the public and other third parties (including movement, conduct, authorised activities and designated and prohibited areas) but not so as to cause an interference with any public right of way;</Addition></Text></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text>“<Term id="term-the-harbour-premises">the harbour premises</Term>” means land adjacent to the wet harbour area and for the time being vested in, or occupied or administered by the Council as part of the harbour undertaking and occupied wholly or mainly for the purpose of activities there carried on; which may include docks, quays, piers, wharves, berths, locks, breakwaters, landing places, yards, roads, sheds, buildings and all other works, conveniences, land and premises which at the date of this Order includes the areas shown shaded blue on the harbour premises plan;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-the-harbour-premises-plan">the harbour premises plan</Term>” means the plan prepared in duplicate, signed on behalf of the Marine Management Organisation and marked “Signed plan referred to in the Weymouth Harbour Revision Order 2021”, one copy of which is deposited at the offices of the Marine Management Organisation and the other at the principal office of the Council;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-harbour-revenue">harbour revenue</Term>” means and includes all moneys receivable by the Council for and in relation to the harbour undertaking other than borrowed moneys and moneys which ought to be carried to capital account;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-the-harbour-undertaking">the harbour undertaking</Term>” means the undertaking carried on by the Council at and in connection with the harbour authorised by this Order and the Acts and Orders listed in Schedule 3 (to the extent that those Acts and Orders relate to the harbour);</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-hovercraft">hovercraft</Term>” means a vehicle which is designed to be supported when in motion wholly or partly by air expelled from the vehicle to form a cushion of which the boundaries include the ground, water or other surface beneath the vehicle;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-inner-harbour-north">Inner Harbour North</Term>” means that part of the harbour which is described in the Schedule to the Order of 1996 and which, for the purposes of identification only, is shown edged red on the signed plan deposited with that Order;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-jet-bike">jet bike</Term>” means any watercraft (not being a structure which by reason of its concave shape provides buoyancy for the carriage of persons or goods) propelled by a water jet engine or other mechanical means of propulsion and steered either—</Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text>by means of a handlebar-operated linkage system (with or without a rudder at the stern), or</Text></Para></ListItem><ListItem><Para><Text>by the person or persons riding the craft using their body weight for the purpose, or</Text></Para></ListItem><ListItem><Para><Text>by a combination of the methods referred to in (a) and (b) above;</Text></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text><CommentaryRef Ref="key-026a487c284fa0b77f015b91af78c50f"/>...</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-the-level-of-high-water">the level of high water</Term>” means the level of mean high-water springs;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-the-level-of-low-water">the level of low water</Term>” means the level of mean low-water springs;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-master">master</Term>”, in relation to a vessel, means any person having or taking command, charge, management or conduct of the vessel for the time being;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-operator">operator</Term>” has the meaning given by paragraph 2 Schedule 3A to the Communications Act 2003;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-seaplane">seaplane</Term>” includes a flying boat and any other aircraft designed to manoeuvre on water but not a hovercraft or hydrofoil vessel;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-special-direction">special direction</Term>” means a direction given under article 24 of this Order;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-statutory-undertaker">statutory undertaker</Term>” means —</Text><OrderedList Decoration="parens" Type="alpha"><ListItem><Para><Text>any person who is a statutory undertaker for any of the purposes of the Town and Country Planning Act 1990<FootnoteRef Ref="f00019"/>,</Text></Para></ListItem><ListItem><Para><Text>a coast protection authority within the meaning of section 1 of the Coast Protection Act 1949<FootnoteRef Ref="f00020"/>,</Text></Para></ListItem><ListItem><Para><Text>any operator of an electronic communications network;</Text></Para></ListItem></OrderedList></Para></ListItem><ListItem><Para><Text>“<Term id="term-trinity-house">Trinity House</Term>” means the Corporation of Trinity House of Deptford Strond;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-vehicle">vehicle</Term>” includes any vehicle propelled on rails, any machinery on wheels or caterpillar tracks, trailers, caravans and mobile homes and includes a hovercraft or any other amphibious vehicle;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-vessel">vessel</Term>” means a ship, boat, houseboat, raft or water craft of any description, however propelled or moved, and includes non-displacement craft, a jet bike, a personal watercraft, a seaplane on the surface of the water, a hydrofoil vessel, a hovercraft or any other amphibious vehicle and any other thing constructed or adapted for floating on or being submersed in water (whether permanently or temporarily);</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-wet-harbour-area">wet harbour area</Term>” means those parts of the area described in article 6(1) of this Order which are covered by water at the level of low water.</Text></Para></ListItem></UnorderedList></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2021/43/article/2/2" IdURI="http://www.legislation.gov.uk/id/uksi/2021/43/article/2/2" id="article-2-2"><Pnumber>2</Pnumber><P2para><Text>All situations, points, directions, distances, lengths, dimensions, areas and other measurements stated in this Order shall be construed as if the words “or thereabouts” were inserted after each such situation, point, direction, distance, length, dimension, area or other measurement.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2021/43/article/2/3" IdURI="http://www.legislation.gov.uk/id/uksi/2021/43/article/2/3" id="article-2-3"><Pnumber>3</Pnumber><P2para><Text>Reference points specified in this Order shall be construed as references to
