<Title>Pension increase: annual rate and lump sums</Title>

<Pnumber>a</Pnumber>
<P3para>
<Text>a person is entitled to an increase in a guaranteed minimum pension on 12th April 2021; and</Text>
</P3para></P3>

<Pnumber>b</Pnumber>

<Text>entitlement to that guaranteed minimum pension arises from an employment from which (either directly, or indirectly by virtue of the payment of a transfer credit) entitlement to the official pension also arises;</Text>
</P3para></P3>
</P2para>
</P2>
<Text>the amount by reference to which any increase is calculated for the purposes of article 3(2) must be reduced by an amount equal to the rate of the guaranteed minimum pension unless the Treasury otherwise direct in accordance with the provisions of section 59A of the Act<FootnoteRef Ref="f00007"/><Strong>.</Strong></Text>

<Text>Where on the death of a deceased spouse or civil partner a person becomes entitled to a guaranteed minimum pension in relation to a surviving spouse’s pension or a surviving civil partner’s pension, the amount by reference to which any increase is calculated for the purposes of article 3(2) must be reduced in accordance with section 59(5ZA) of the Act.</Text>

<P><Text>Article 4 of the Order provides for increases on certain deferred lump sums which become payable on or after 6th April 2020 and before 12th April 2021.</Text></P>
<P><Text>The Order also makes provision for the amount by reference to which any increase in the rate of an official pension is to be calculated to be reduced by the amount equal to the rate of the guaranteed minimum pension entitlement deriving from the employment which gives rise to the official pension.</Text></P>
<P><Text>A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.</Text></P>

Section 59(5) was amended by section 11 of the Social Security Act <Citation URI="http://www.legislation.gov.uk/id/ukpga/1979/18" id="c00010" Class="UnitedKingdomPublicGeneralAct" Year="1979" Number="0018">1979 (c.18)</Citation> and the Social Security Act <Citation URI="http://www.legislation.gov.uk/id/ukpga/1985/53" id="c00011" Class="UnitedKingdomPublicGeneralAct" Year="1985" Number="0053">1985 (c.53)</Citation>, Schedule 5, paragraph 33. Section 59 was also amended by the Social Security Act 1979, section 11 and Schedule 3, paragraph 20; section 5 of the Pensions (Miscellaneous Provisions) Act 1990 (which inserted subsection (5ZA)) and the Pensions Schemes Act <Citation URI="http://www.legislation.gov.uk/id/ukpga/1993/48" id="c00012" Class="UnitedKingdomPublicGeneralAct" Year="1993" Number="0048">1993 (c.48)</Citation>, section 190 and Schedule 8, paragraph 9(1). Section 59 was modified by section 59A, which was inserted by section 11(4) of the Social Security Act 1979, amended by the Social Security Act 1986, section 9(9), and further amended by the Pensions Schemes Act 1993, section 190 and Schedule 8, paragraph 9(2).
