The Police and Crime Commissioner Elections (Designation of Police Area Returning Officers) (Amendment) Order 2021

The Minister for the Cabinet Office makes the following Order in exercise of the powers conferred by sections 54(1)(b) and 154(5)(a) and (b) of the Police Reform and Social Responsibility Act 20111.
Before making this Order, the Minister for the Cabinet Office consulted the Electoral Commission in accordance with section 7(1) and (2)(ha) of the Political Parties Elections and Referendums Act 20002.

Citation and commencement1.

(1)

This Order may be cited as the Police and Crime Commissioner Elections (Designation of Police Area Returning Officers) (Amendment) Order 2021.

(2)

It comes into force on the day after the day on which it is made.

Amendment of 2020 Order2.

(1)

The Police and Crime Commissioner Elections (Designation of Police Area Returning Officers) Order 20203 is amended as follows.

(2)

Omit article 4 (revocation and saving).

(3)

In the table in Schedule 1 (police area returning officers: England)—

(a)

in the entry relating to the police area of Surrey, in column 2, for “Reigate” substitute “Runnymede and Weybridge”;

(b)

omit the entry relating to the police area of West Yorkshire4.

(4)

In the table in Schedule 2 (police area returning officers: Wales), in the entry relating to the police area of Dyfed-Powys, in column 2, for “Carmarthen West and South Pembrokeshire” substitute “Ceredigion”.

Transitory provision3.

The amendments made by article 2 have no effect in respect of any election which takes place before 6th May 2021.

EXPLANATORY NOTE
(This note is not part of the Order)

This Order amends the Police and Crime Commissioner Elections (Designation of Police Area Returning Officers) Order 2020 (S.I. 2020/136) (“the 2020 Order”).

The 2020 Order designated, under section 54(1)(b) of the Police Reform and Social Responsibility Act 2011 (c. 13), the persons who, in elections of police and crime commissioners, are to be the returning officers for the police areas named in Schedules 1 and 2 to that Order (for England and for Wales). Article 2 of this Order makes changes in respect of the police areas set out there. Article 3 provides that these changes will not affect any election held before 6th May 2021.

An impact assessment has not been produced for this instrument as no, or no significant, impact on the private voluntary or public sectors is foreseen.
