8.—(1) Schedule 1 to the Ecodesign for Energy-Related Products Regulations 2010(1) (declaration of conformity) is amended as follows.
(2) In the table at paragraph 4—
(a)omit the entry relating to item 10 (a boiler or an appliance)(2);
(b)in relation to the products listed in the following table, for the existing text in the final column substitute the text in the final column of the following table—

S.I. 2010/2617. Schedule 1 has been amended by S.I. 2011/2677, 2012/3005, 2013/1232, 2014/1290, 2015/469, 2016/838, 2017/1143, 2019/539, 2019/1253, 2020/485 and S.I. 2021/1095. The amendments made by S.I. 2019/539 and S.I. 2021/1095 extend to England and Wales and Scotland only. The insertion of item 29 (a solid fuel local space heater) by S.I. 2017/1143 comes into force on 1st January 2022.
Boilers are a form of space heater or combination heater, as defined in Commission Regulation (EU) No 813/2013 of 2 August 2013 implementing Directive 2009/125/EC of the European Parliament and of the Council with regard to ecodesign requirements for space heaters and combination heaters (EUR 2013/813), for which see row 21 of the table at paragraph 4 of Schedule 1 to S.I. 2010/2617.

Commission Regulation (EC) No 1275/2008 originally implemented Directive 2005/32/EC of the European Parliament and of the Council of 6 July 2005 establishing a framework for the setting of ecodesign requirements for energy-using products and amending Council Directive 92/42/EEC and Directives 96/57/EC and 2000/55/EC of the European Parliament and of the Council (“Directive 2005/32/EC”). Directive 2005/32/EC was repealed by Directive 2009/125/EC of the European Parliament and of the Council of 21 October 2009 establishing a framework for the setting of ecodesign requirements for energy-related products (“Directive 2009/125/EC”), which provided for references to Directive 2005/32/EC to be construed as references to Directive 2009/125/EC and to be read in accordance with the correlation table set out in Annex 10.
