The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 45B, 45F(2) and 45P(2) of the Public Health (Control of Disease) Act 19841.

Citation, commencement, extent and application1.

(1)

These Regulations may be cited as the Health Protection (Coronavirus, International Travel and Operator Liability) (England) (Amendment) (No. 11) Regulations 2021.

(2)

These Regulations come into force at 4.00 a.m. on 14th September 2021.

(3)

These Regulations extend to England and Wales, and apply in relation to England only.

Amendments to the Health Protection (Coronavirus, International Travel and Operator Liability) (England) Regulations 20212.

The Health Protection (Coronavirus, International Travel and Operator Liability) (England) Regulations 20212 are amended as follows.

Amendment of Schedule 53.

In Schedule 5 (list of sporting events), for “UEFA Champions League and Europa League fixtures” substitute “UEFA Champions League, Europa League and Europa Conference League fixtures”.

Amendment of Schedule 114.

(1)

Paragraph 2 of Schedule 11 (additional measures) is amended as follows.

(2)

In sub-paragraphs (1)(h), (1)(j) and (1)(k), after “in paragraph 44(2) of Schedule 4” insert “(but as if for “category 2” there were substituted “category 3” in each place it appears)”.

(3)

In sub-paragraph (1), after paragraph (l) insert—

“(la)

an international elite sportsperson as defined in paragraph 44(2) of Schedule 4 (but as if for “category 2” there were substituted “category 3”), provided—

(i)

they have departed from or transited through the category 3 country or territory in order to compete in an elite sports event as defined in paragraph 44(2) of Schedule 4, and

(ii)

the competition for which they are travelling to England is an elite sports event specified in sub-paragraph (3A);”.

(4)

After sub-paragraph (3) insert—

“(3A)

The following elite sports events are specified for the purposes of sub-paragraph (1)(la)(ii)—

(a)

UEFA Champions League fixtures;

(b)

UEFA Europa League fixtures;

(c)

UEFA Europa Conference League fixtures.”.

EXPLANATORY NOTE
(This note is not part of the Regulations)

These Regulations amend Schedules 5 and 11 to the Health Protection (Coronavirus, International Travel and Operator Liability) (England) Regulations 2021 (S.I. 2021/582).

The amendment to Schedule 5 updates the list of specified sporting events.

As a result of the amendments to Schedule 11, the additional measures that apply to arrivals from category 3 countries and territories do not apply to international elite sportspersons who travel to or through a category 3 country or territory to compete in an elite sports event, if they thereafter travel to England to compete in a UEFA Champions League, Europa League or Europa Conference League match.

Paragraphs 2(1)(h), (j), (k) and (zn) of Schedule 11 cross-refer to definitions in paragraph 44(2) of Schedule 4. The amendments also modify the effect these definitions have when used in Schedule 11, to ensure they apply to persons arriving in England from category 3 countries and territories.
