Section 106 was amended by section 35(1) and (8) of, and Schedule 2 to, the Competition and Service (Utilities) Act <ref eId="c00049" href="http://www.legislation.gov.uk/id/ukpga/1992/43">1992 (c. 43)</ref>, sections 36(2) and 99 of the Water Act <ref eId="c00050" href="http://www.legislation.gov.uk/id/ukpga/2003/37">2003 (c. 37)</ref> and paragraph 16(1) of Schedule 3 to the Flood and Water Management Act <ref eId="c00051" href="http://www.legislation.gov.uk/id/ukpga/2010/29">2010 (c. 29)</ref>.</p></authorialNote>.</p></content></paragraph><paragraph eId="article-21-3"><num>(3)</num><content><p>The undertaker must not discharge any water into any watercourse, public sewer or drain except with the consent of the person to whom it belongs; and such consent may be given subject to such terms and conditions as that person may reasonably impose, but must not be unreasonably withheld.</p></content></paragraph><paragraph eId="article-21-4"><num>(4)</num><intro><p>The undertaker must not make any opening into any public sewer or drain except—</p></intro><level class="para1" eId="article-21-4-a"><num>(a)</num><content><p>in accordance with plans approved by the person to whom the sewer or drain belongs, but such approval must not be unreasonably withheld; and</p></content></level><level class="para1" eId="article-21-4-b"><num>(b)</num><content><p>where that person has been given the opportunity to supervise the making of the opening.</p></content></level></paragraph><paragraph eId="article-21-5"><num>(5)</num><content><p>Save where permitted by this Order, the undertaker must not, in carrying out or maintaining works under this article, damage or interfere with the bed or banks of any watercourse forming part of a main river.</p></content></paragraph><paragraph eId="article-21-6"><num>(6)</num><content><p>The undertaker must take such steps as are reasonably practicable to secure that any water discharged into a watercourse or public sewer or drain pursuant to this article is as free as may be practicable from gravel, soil or other solid substance, oil or matter in suspension.</p></content></paragraph><paragraph eId="article-21-7"><num>(7)</num><content><p>Nothing in this article overrides the requirement for an environmental permit under regulation 12(1)(b) (requirement for environmental permit) of the Environmental Permitting (England and Wales) Regulations 2016<authorialNote class="footnote" eId="f00044" marker="44"><p><ref eId="c00052" href="http://www.legislation.gov.uk/id/uksi/2016/1154">S.I. 2016/1154</ref>.</p></authorialNote>.</p></content></paragraph><paragraph eId="article-21-8"><num>(8)</num><intro><p>In this article—</p></intro><level class="para1" eId="article-21-8-a"><num>(a)</num><content><p>“public sewer or drain” means a sewer or drain which belongs to the Homes England, the Environment Agency, an internal drainage board, a joint planning board, a local authority, a sewerage undertaker or an urban development corporation; and</p></content></level><level class="para1" eId="article-21-8-b"><num>(b)</num><content><p>other expressions, excluding watercourse, used both in this article and in the Water Resources Act 1991<authorialNote class="footnote" eId="f00045" marker="45"><p><ref eId="c00053" href="http://www.legislation.gov.uk/id/ukpga/1991/57">1991 c. 57</ref>.</p></authorialNote> have the same meaning as in that Act.</p></content></level></paragraph><paragraph eId="article-21-9"><num>(9)</num><content><p>If a person who receives an application for consent under paragraph (3) or approval under paragraph (4)(a) fails to notify the undertaker of a decision within 28 days of receiving an application that person is deemed to have granted consent or given approval, as the case may be.</p></content></paragraph><paragraph eId="article-21-10"><num>(10)</num><content><p>Any application to which this article applies must include a statement that the provisions of paragraph (9) apply to that application.</p></content></paragraph></article></part></body></act></akomaNtoso>
