        </Number><Title>STREETS</Title><P1group RestrictStartDate="2020-05-25"><Title>Traffic Regulation</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2020/511/article/17" IdURI="http://www.legislation.gov.uk/id/uksi/2020/511/article/17" id="article-17"><Pnumber>17</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2020/511/article/17/1" IdURI="http://www.legislation.gov.uk/id/uksi/2020/511/article/17/1" id="article-17-1"><Pnumber>1</Pnumber><P2para><Text>The orders referred to in columns (1) and (2) of Part 1 of Schedule 9 (traffic regulation) are revoked or amended as set out in column (3) of Part 1 of Schedule 9 upon the event listed in column (4) of that Part of that Schedule occurring.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2020/511/article/17/2" IdURI="http://www.legislation.gov.uk/id/uksi/2020/511/article/17/2" id="article-17-2"><Pnumber>2</Pnumber><P2para><Text>Without limiting the scope of the specific powers conferred by paragraph (1) but subject to the provisions of this article and the consent of the relevant traffic authority, such consent not to be unreasonably withheld but which may be subject to reasonable conditions, the undertaker may, in so far as may be expedient or necessary for the purposes of or in connection with the construction, operation or maintenance of the authorised development—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2020/511/article/17/2/a" IdURI="http://www.legislation.gov.uk/id/uksi/2020/511/article/17/2/a" id="article-17-2-a"><Pnumber>a</Pnumber><P3para><Text>revoke, amend or suspend in whole or in part any order made, or having effect as if made, under the 1984 Act;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2020/511/article/17/2/b" IdURI="http://www.legislation.gov.uk/id/uksi/2020/511/article/17/2/b" id="article-17-2-b"><Pnumber>b</Pnumber><P3para><Text>permit, prohibit or restrict the stopping, parking, waiting, loading or unloading of vehicles on any road;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2020/511/article/17/2/c" IdURI="http://www.legislation.gov.uk/id/uksi/2020/511/article/17/2/c" id="article-17-2-c"><Pnumber>c</Pnumber><P3para><Text>suspend or authorise the use as a parking place of any road;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2020/511/article/17/2/d" IdURI="http://www.legislation.gov.uk/id/uksi/2020/511/article/17/2/d" id="article-17-2-d"><Pnumber>d</Pnumber><P3para><Text>make provision as to the direction or priority of vehicular traffic on any road; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2020/511/article/17/2/e" IdURI="http://www.legislation.gov.uk/id/uksi/2020/511/article/17/2/e" id="article-17-2-e"><Pnumber>e</Pnumber><P3para><Text>permit or prohibit vehicular access to any road,</Text></P3para></P3><Text>either at all times or at times, on days or during such periods as may be specified by the undertaker.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2020/511/article/17/3" IdURI="http://www.legislation.gov.uk/id/uksi/2020/511/article/17/3" id="article-17-3"><Pnumber>3</Pnumber><P2para><Text>The undertaker must not exercise the powers in paragraph (2) unless it has—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2020/511/article/17/3/a" IdURI="http://www.legislation.gov.uk/id/uksi/2020/511/article/17/3/a" id="article-17-3-a"><Pnumber>a</Pnumber><P3para><Text>given not less than 4 weeks' notice in writing of its intention so to do to the chief officer of police and to the relevant traffic authority; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2020/511/article/17/3/b" IdURI="http://www.legislation.gov.uk/id/uksi/2020/511/article/17/3/b" id="article-17-3-b"><Pnumber>b</Pnumber><P3para><Text>advertised its intention in such manner as the relevant traffic authority may specify in writing within 7 days of the relevant traffic authority's receipt of notice of the undertaker's intention under sub-paragraph (a).</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2020/511/article/17/4" IdURI="http://www.legislation.gov.uk/id/uksi/2020/511/article/17/4" id="article-17-4"><Pnumber>4</Pnumber><P2para><Text>Any prohibition, restriction or other provision made by the undertaker under paragraph (2) is to—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2020/511/article/17/4/a" IdURI="http://www.legislation.gov.uk/id/uksi/2020/511/article/17/4/a" id="article-17-4-a"><Pnumber>a</Pnumber><P3para><Text>have effect as if duly made by, as the case may be—</Text><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2020/511/article/17/4/a/i" IdURI="http://www.legislation.gov.uk/id/uksi/2020/511/article/17/4/a/i" id="article-17-4-a-i"><Pnumber>i</Pnumber><P4para><Text>the relevant traffic authority as a traffic regulation order under the 1984 Act; or</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2020/511/article/17/4/a/ii" IdURI="http://www.legislation.gov.uk/id/uksi/2020/511/article/17/4/a/ii" id="article-17-4-a-ii"><Pnumber>ii</Pnumber><P4para><Text>the local authority in whose area the road is situated as an order under section 32 <CommentaryRef Ref="c24098931"/> (power of local authorities to provide parking places) of the 1984 Act; and</Text></P4para></P4></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2020/511/article/17/4/b" IdURI="http://www.legislation.gov.uk/id/uksi/2020/511/article/17/4/b" id="article-17-4-b"><Pnumber>b</Pnumber><P3para><Text>be deemed to be a traffic order for the purposes of Schedule 7 (road traffic contraventions subject to civil enforcement) to the Traffic Management Act 2004.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2020/511/article/17/5" IdURI="http://www.legislation.gov.uk/id/uksi/2020/511/article/17/5" id="article-17-5"><Pnumber>5</Pnumber><P2para><Text>Any prohibition, restriction or other provision made under this article may be suspended, varied or revoked by the undertaker from time to time by subsequent exercise of the powers conferred by paragraph (2) at any time.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2020/511/article/17/6" IdURI="http://www.legislation.gov.uk/id/uksi/2020/511/article/17/6" id="article-17-6"><Pnumber>6</Pnumber><P2para><Text>Expressions used in this article and in the 1984 Act have the same meaning in this article as in that Act.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2020/511/article/17/7" IdURI="http://www.legislation.gov.uk/id/uksi/2020/511/article/17/7" id="article-17-7"><Pnumber>7</Pnumber><P2para><Text>If the relevant traffic authority fails to notify the undertaker of its decision within 42 days of receiving an application for consent under paragraph (2) that is accompanied by all relevant information the relevant traffic authority is deemed to have given consent.</Text></P2para></P2></P1para></P1></P1group></Part></Body></Secondary><Commentaries><Commentary id="c24098931" Type="M"><Para><Text><CitationSubRef id="c00086" URI="http://www.legislation.gov.uk/id/uksi/2020/511/section/32" SectionRef="section-32">Section 32</CitationSubRef> was amended by section 102 of, and Schedule 17 to, the <Citation URI="http://www.legislation.gov.uk/id/ukpga/1985/51" id="c00087" Year="1985" Class="UnitedKingdomPublicGeneralAct" Number="51" Title="Local Government Act 1985">Local Government Act 1985 (c. 51)</Citation>.
