The Offender Management Act 2007 (Coronavirus) (Approved Premises) (Amendment) Regulations 2020

The Secretary of State, in exercise of the powers conferred by sections 13(2) and 36(2)(a) of the Offender Management Act 20071, makes the following Regulations.

Citation and commencement1.

These Regulations may be cited as the Offender Management Act 2007 (Coronavirus) (Approved Premises) (Amendment) Regulations 2020 and shall come into force at 12.01 a.m. on 6th April 2020.

Amendment to the Offender Management Act 2007 (Approved Premises) Regulations 20142.

In the definition of “licence” in regulation 4 (interpretation) of the Offender Management Act 2007 (Approved Premises) Regulations 20142, after “rule 9” insert “or rule 9A”.

EXPLANATORY NOTE
(This note is not part of the Regulations)

These Regulations make consequential amendment to regulation 4 of the Offender Management Act 2007 (Approved Premises) Regulations 2014 (S.I. 2014/1198) (“the 2014 Regulations”), following the creation of a new coronavirus restricted temporary release provision by the Prison and Young Offender Institution (Coronavirus) (Amendment) Rules 2020 (S.I. 2020/400).

The instrument amends the definition of “licence” in regulation 4 of the 2014 Regulations to refer to the new coronavirus restricted temporary release provision, enabling those released under that provision to be housed in approved premises.
