Article 56Regulations
1
Any power to make regulations conferred on the Secretary of State by this Regulation is exercisable by statutory instrument.

Such regulations may:
a
contain supplementary, incidental, consequential, transitional or saving provision (including provision amending, repealing or revoking an enactment);
b
make different provision for different purposes.

Except as specified in paragraph 4, a statutory instrument containing regulations under this Regulation is subject to annulment in pursuance of a resolution of either House of Parliament.

A statutory instrument containing regulations made under the second subparagraph of Article 2(1) or Article 18(5), 30(1) or 41(3) may not be made unless a draft of the instrument has been laid before, and approved by a resolution of, each House of Parliament.

Before making any regulations under this Regulation, the Secretary of State must consult:
a
such bodies or persons as appear to the Secretary of State to be representative of the interests likely to be substantially affected by the regulations;
b
such other bodies or persons as the Secretary of State may consider appropriate.

In this Article, ‘enactment’ means:
a
an enactment contained in any Order in Council, order, rules, regulations or other instrument made under an Act, except so far as it extends to Northern Ireland;
b
regulations made under retained direct principal EU legislation, except so far as they extend to Northern Ireland;
c
retained direct minor EU legislation, except so far as it extends to Northern Ireland.
