Amendment of article 94A7

Article 94A (small unmanned aircraft: permissions for certain flights) is amended as follows.

For article 94A(1) substitute—
Certain unmanned aircraft: permission for flights that are over or near aerodromes94A

If the permission that is required under paragraph (4) of this article for a flight, or a part of a flight, by an unmanned aircraft has not been obtained—
a
the UAS operator must not cause or permit the unmanned aircraft to be flown on that flight or that part of the flight, and
b
the remote pilot must not fly the unmanned aircraft on that flight or that part of that flight.

Omit paragraphs (2) and (3).

In paragraph (4), in the words before sub-paragraph (a)—
a
at the beginning, insert “Subject to paragraph (4A),”;
b
for “a small unmanned aircraft” substitute “an unmanned aircraft”.

After paragraph (4), insert—

Permission is not required under paragraph (4) for a flight, or a part of a flight, by an unmanned aircraft subject to certification.
