The Immigration and Social Security Co-ordination (EU Withdrawal) Act 2020 (Commencement) Regulations 2020

The Secretary of State makes these Regulations in exercise of the powers conferred by section 9(1) and (3) to (5) of the Immigration and Social Security Co-ordination (EU Withdrawal) Act 20201.
Citation and interpretation1

These Regulations may be cited as the Immigration and Social Security Co-ordination (EU Withdrawal) Act 2020 (Commencement) Regulations 2020.

In these Regulations, “the Act” means the Immigration and Social Security Co-ordination (EU Withdrawal) Act 2020.
Commencement

The following provisions of the Act come into force on the day after the day on which these Regulations are made—
a
section 5;
b
section 6;
c
Schedule 2;
d
Schedule 3.

Section 2 (Irish citizens: entitlement to enter or remain without leave) of the Act comes into force immediately before IP completion day2.
4
The following provisions of the Act come into force on IP completion day for all purposes—
a
section 1 (repeal of the main retained EU law relating to free movement etc.);
b
section 4 (meaning of “the Immigration Acts” etc.);
c
Schedule 1 (repeal of the main retained EU law relating to free movement etc.).

Section 3 (protection claimants: legal routes from the EU and family reunion) of the Act, so far as not already brought into force by section 9(2) of the Act, comes into force on 12th January 2021.
