The Secretary of State, in exercise of the power conferred by section 2(1) of the Northern Ireland (Executive Formation and Exercise of Functions) Act 2018(1), makes the following Regulations.

The Secretary of State considers it to be expedient for the Regulations to be made without the approval of each House of Parliament(2).

Citation and commencement

1.—(1) These Regulations may be cited as the Northern Ireland (Extension of Period for Executive Formation) Regulations 2019.

(2) They come into force on 25th March 2019.

Amendment of section 1(1) of the Northern Ireland (Executive Formation and Exercise of Functions) Act 2018

2.  In section 1(1) of the Northern Ireland (Executive Formation and Exercise of Functions) Act 2018, for “26 March 2019” substitute “25 August 2019”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

Section 1 of the Northern Ireland (Executive Formation and Exercise of Functions) Act 2018 (c. 28) (“the 2018 Act”) extended the time under section 16A of the Northern Ireland Act 1998 (c. 47) for Northern Ireland Ministers to be appointed until 26th March 2019. Section 2(1) of the 2018 Act allows the Secretary of State, by regulations, to extend that period for one further period of up to 5 months.

These Regulations extend the period for the appointment of Northern Ireland Ministers by 5 months so that the period for the appointment of Northern Ireland Ministers under the Northern Ireland Act 1998 ends with 25th August 2019.

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sectors is foreseen.
