Class="Definition"><ListItem><Para><Text>“<Term id="term-the-act">the Act</Term>” means the Welfare Reform Act 2012;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-the-2002-act">the 2002 Act</Term>” means the Tax Credits Act 2002 <CommentaryRef Ref="c23550071"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-the-2015-order-n.i.">the 2015 Order (N.I.)</Term>” means the Welfare Reform (Northern Ireland) Order 2015 <CommentaryRef Ref="c23550081"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-the-no.-8-order-n.i.">the No. 8 Order (N.I.)</Term>” means the Welfare Reform (Northern Ireland) Order 2015 (Commencement No. 8 and Transitional and Transitory Provisions) Order 2017 <CommentaryRef Ref="c23550091"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-the-no.-9-order">the No. 9 Order</Term>” means the Welfare Reform Act 2012 (Commencement No. 9 and Transitional and Transitory Provisions and Commencement No. 8 and Savings and Transitional Provisions (Amendment)) Order 2013 <CommentaryRef Ref="c23550101"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-the-no.-21-order">the No. 21 Order</Term>” means the Welfare Reform Act 2012 (Commencement No. 21 and Transitional and Transitory Provisions) Order 2015 <CommentaryRef Ref="c23550111"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-the-no.-23-order">the No. 23 Order</Term>” means the Welfare Reform Act 2012 (Commencement No. 23 and Transitional and Transitory Provisions) Order 2015 <CommentaryRef Ref="c23550121"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-the-claims-and-payments-regulations-1987">the Claims and Payments Regulations 1987</Term>” means the Social Security (Claims and Payments) Regulations 1987 <CommentaryRef Ref="c23550131"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-couple">couple</Term>” means a couple as defined in section 3(5A) of the 2002 Act <CommentaryRef Ref="c23550141"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-employment-and-support-allowance">employment and support allowance</Term>” means an employment and support allowance under Part 1 of the Welfare Reform Act 2007 <CommentaryRef Ref="c23550151"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-jobseekers-allowance">jobseeker's allowance</Term>” means a jobseeker's allowance under the Jobseekers Act 1995 <CommentaryRef Ref="c23550161"/>;</Text></Para></ListItem><ListItem><Para><Text>“joint-claim couple” has the same meanings as in the Jobseeker's Act 1995;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-her-majestys-forces">Her Majesty's forces</Term>” has the same meaning as in the Armed Forces Act 2006 <CommentaryRef Ref="c23550171"/>;</Text></Para></ListItem><ListItem><Para><Text> <Addition ChangeId="key-4dbbee3448f4b955ae2077dbbe329df7-1719238009522" CommentaryRef="key-4dbbee3448f4b955ae2077dbbe329df7">“</Addition><Term><Addition ChangeId="key-4dbbee3448f4b955ae2077dbbe329df7-1719238009522" CommentaryRef="key-4dbbee3448f4b955ae2077dbbe329df7">migration notice</Addition></Term><Addition ChangeId="key-4dbbee3448f4b955ae2077dbbe329df7-1719238009522" CommentaryRef="key-4dbbee3448f4b955ae2077dbbe329df7">” means a notice under regulation 44 (migration notice) of the Universal Credit (Transitional Provisions) Regulations 2014 or a notice under regulation 45 (migration notice) of the Universal Credit (Transitional Provisions) Regulations (Northern Ireland) 2016;</Addition> </Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-mixed-age-couple">mixed-age couple</Term>” means a couple, one member of which has attained the qualifying age and the other of which has not;</Text></Para></ListItem><ListItem><Para><Text> <Addition ChangeId="key-4dbbee3448f4b955ae2077dbbe329df7-1719238056726" CommentaryRef="key-4dbbee3448f4b955ae2077dbbe329df7">“</Addition><Term><Addition ChangeId="key-4dbbee3448f4b955ae2077dbbe329df7-1719238056726" CommentaryRef="key-4dbbee3448f4b955ae2077dbbe329df7">notified person</Addition></Term><Addition ChangeId="key-4dbbee3448f4b955ae2077dbbe329df7-1719238056726" CommentaryRef="key-4dbbee3448f4b955ae2077dbbe329df7">” means a person to whom a notice has been issued under article 3A (tax credit closure notice);</Addition> </Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-polygamous-unit">polygamous unit</Term>” means a polygamous unit within the meaning of the Tax Credits (Polygamous Marriages) Regulations 2003 <CommentaryRef Ref="c23550181"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-qualifying-age">qualifying age</Term>” means the qualifying age for state pension credit as defined in section 1(6) of the State Pension Credit Act 2002 <CommentaryRef Ref="c23550191"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-single-claimant">single claimant</Term>” means a person who makes a single claim for a tax credit as referred to in section 3(3)(b) of the 2002 Act;</Text></Para></ListItem><ListItem><Para><Text> <Addition ChangeId="key-4dbbee3448f4b955ae2077dbbe329df7-1719238097521" CommentaryRef="key-4dbbee3448f4b955ae2077dbbe329df7">“</Addition><Term><Addition ChangeId="key-4dbbee3448f4b955ae2077dbbe329df7-1719238097521" CommentaryRef="key-4dbbee3448f4b955ae2077dbbe329df7">state pension credit</Addition></Term><Addition ChangeId="key-4dbbee3448f4b955ae2077dbbe329df7-1719238097521" CommentaryRef="key-4dbbee3448f4b955ae2077dbbe329df7">” means state pension credit under the State Pension Credit Act 2002 or the State Pension Credit Act (Northern Ireland) 2002;</Addition> </Text></Para></ListItem><ListItem><Para><Text>“tax credit” (including  “child tax credit” and  “working tax credit”) have the same meanings as in the 2002 Act and  “<Term id="term-tax-year">tax year</Term>” has the same meaning as in Part 1 of that Act;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-uc-age-condition">UC age condition</Term>” means the condition in section 4(1)(b) of the Act for Great Britain or Article 9(1)(b) of the 2015 Order (N.I.) for Northern Ireland, subject to any exceptions in any instrument made under the Act or 2015 Order (N.I.);</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-uc-couple">UC couple</Term>” means a couple as defined in section 39 of the Act for Great Britain or Article 45 of the 2015 Order (N.I.) for Northern Ireland (in article 4, as defined in that section 39);</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-uc-joint-claimants">UC joint claimants</Term>” means joint claimants as defined in section 40 of the Act for Great Britain or Article 46 of the 2015 Order (N.I.) for Northern Ireland (in article 4, as defined in that section 40);</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-uc-provisions">UC provisions</Term>” means the provisions listed in Schedule 2 to the No. 9 Order;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-uc-single-claimant">UC single claimant</Term>” means a single claimant as defined in section 40 of the Act for Great Britain or Article 46 of the 2015 Order (N.I.) for Northern Ireland (in article 4, as defined in that section 40);</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-uc-transitional-provisions">UC transitional provisions</Term>” means the orders made under section 150(3) of the Act or Article 2(2) of the 2015 Order (N.I.) that commence the UC provisions, or the provisions listed in Schedule 1 to the No. 8 Order (N.I.), respectively, and the regulations made under Schedule 6 to the Act or Schedule 6 to the 2015 Order (N.I.).</Text></Para></ListItem></UnorderedList></P2para></P2><P2 RestrictStartDate="2019-01-31"><Title>Commencement of provisions on abolition of tax credits</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/2" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/2" id="article-2"><Pnumber>2</Pnumber><P1para><Text>The day appointed for the coming into force of section 33(1)(f) of the Act (abolition of tax credits) and the repeal of Part 1 of the 2002 Act (but not Schedule 1 or 3), by Part 1 of Schedule 14 to the Act, is 1st February 2019.</Text></P1para></P1></P1group><P1group RestrictExtent="E+W+S+N.I." RestrictStartDate="2025-04-06"><Title>Savings</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/3" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/3" id="article-3"><Pnumber>3</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/3/1" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/3/1" id="article-3-1"><Pnumber>1</Pnumber><P2para><Text><Addition ChangeId="key-34ad8e8fbef0f115fc372b0689cd9546-1719238262965" CommentaryRef="key-34ad8e8fbef0f115fc372b0689cd9546">Subject to articles 3A (tax credit closure notice) and 3B (saving to cease following issue of tax credit closure notice),</Addition> section 33(1)(f) of the Act, and the repeal of Part 1 of the 2002 Act (but not Schedule 1 or 3) by Part 1 of Schedule 14 to the Act, shall be treated as though they had not come into force, in relation to a case as referred to in paragraph (2), (3), (4), (5) or (9).</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/3/2" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/3/2" id="article-3-2"><Pnumber>2</Pnumber><P2para><Text>The case referred to is the case of an award of a tax credit that has effect for a period that includes 31st January 2019.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/3/3" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/3/3" id="article-3-3"><Pnumber>3</Pnumber><P2para><Text>The case referred to is the case of an award of a tax credit where the period for which it has effect begins on or after 1st February 2019 and where the claim for the award is made by—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/3/3/a" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/3/3/a" id="article-3-3-a"><Pnumber>a</Pnumber><P3para><Text>a single claimant who is, or a couple both members of which are, aged under the qualifying age on the day that the claim is made;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/3/3/b" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/3/3/b" id="article-3-3-b"><Pnumber>b</Pnumber><P3para><Text>a mixed-age couple which is also a UC couple on that day; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/3/3/c" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/3/3/c" id="article-3-3-c"><Pnumber>c</Pnumber><P3para><Text>a polygamous unit which on that day consists wholly of persons who, ignoring any restrictions on claiming universal credit in the UC transitional provisions, could claim universal credit, and meet the UC age condition, as—</Text><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/3/3/c/i" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/3/3/c/i" id="article-3-3-c-i"><Pnumber>i</Pnumber><P4para><Text>UC joint claimants and one or more UC single claimants; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/3/4/b" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/3/4/b" id="article-3-4-b"><Pnumber>b</Pnumber><P3para><Text>a polygamous unit apart from one referred to in paragraph (3)(c),</Text></P3para></P3><Text>where, on the day on which the claim is made, a member of the couple, or a member or members of the polygamous unit, would be able to claim universal credit were it not for restrictions on claiming universal credit in the UC transitional provisions.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/3/5" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/3/5" id="article-3-5"><Pnumber>5</Pnumber><P2para><Text>The case referred to is a case, not falling within paragraph (3) or (4), of—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/3/5/a" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/3/5/a" id="article-3-5-a"><Pnumber>a</Pnumber><P3para><Text>an award of child tax credit where the period for which it has effect begins on or after 1st February 2019 and where, on the day on which the claimant or claimants of the award makes or make the claim for it, he or she (or they) has or have an award of working tax credit;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/3/5/b" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/3/5/b" id="article-3-5-b"><Pnumber>b</Pnumber><P3para><Text>an award of working tax credit where the period for which it has effect begins on or after 1st February 2019 and where, on the day on which the claimant or claimants of the award makes or make the claim for it, he or she (or they) has or have an award of child tax credit;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/3/5/c" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/3/5/c" id="article-3-5-c"><Pnumber>c</Pnumber><P3para><Text>an award of child tax credit or working tax credit where the period for which it has effect begins on or after 1st February 2019 and where the claimant or claimants who makes or make the claim for the award had an award of the same type of tax credit for the previous tax year to the tax year for which the award is made.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/3/6" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/3/6" id="article-3-6"><Pnumber>6</Pnumber><P2para><Text>For the purposes of paragraph (5)(a) and (b)—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/3/6/a" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/3/6/a" id="article-3-6-a"><Pnumber>a</Pnumber><P3para><Text>a person is to be treated as having an award of working tax credit with effect from the start of a tax year (“current tax year”) even though a decision has not been made under section 14 of the 2002 Act in respect of a claim for that tax credit for that tax year, if the person had an award of working tax credit for the previous tax year and any of the cases specified in paragraph (7) applies; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/3/6/b" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/3/6/b" id="article-3-6-b"><Pnumber>b</Pnumber><P3para><Text>a person is to be treated as having an award of child tax credit with effect from the start of a tax year (“current tax year”) even though a decision has not been made under section 14 of the 2002 Act in respect of a claim for that tax credit for that tax year, if the person had an award of child tax credit for the previous tax year and any of the cases specified in paragraph (7) applies.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/3/7" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/3/7" id="article-3-7"><Pnumber>7</Pnumber><P2para><Text>The cases are—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/3/7/a" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/3/7/a" id="article-3-7-a"><Pnumber>a</Pnumber><P3para><Text>a final notice has not been given to the person under section 17 of the 2002 Act in respect of that previous tax year;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/3/7/b" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/3/7/b" id="article-3-7-b"><Pnumber>b</Pnumber><P3para><Text>a final notice has been given, which includes provision by virtue of subsections (2) and (4) of section 17, or a combination of those subsections and subsection (6) of that section and—</Text><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/3/7/b/i" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/3/7/b/i" id="article-3-7-b-i"><Pnumber>i</Pnumber><P4para><Text>the date specified in the notice for the purposes of section 17(2) and (4) or, where different dates are specified, the later of them, has not yet passed and no claim for a tax credit for the current tax year has been made, or treated as made; or</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/3/7/b/ii" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/3/7/b/ii" id="article-3-7-b-ii"><Pnumber>ii</Pnumber><P4para><Text>a claim for a tax credit has been made, or treated as made, on or before the date mentioned in paragraph (i), but no decision has been made in relation to that claim under section 14(1) of the 2002 Act;</Text></P4para></P4></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/3/7/c" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/3/7/c" id="article-3-7-c"><Pnumber>c</Pnumber><P3para><Text>a final notice has been given, no claim for a tax credit for the current tax year has been made, or treated as made, and no decision has been made under section 18(1) of the 2002 Act in respect of entitlement to a tax credit for the previous tax year;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/3/7/d" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/3/7/d" id="article-3-7-d"><Pnumber>d</Pnumber><P3para><Text>a final notice has been given and the person made a declaration in response to a requirement included in that notice by virtue of section 17(2)(a), (4)(a) or (6)(a), or any combination of those provisions—</Text><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/3/7/d/i" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/3/7/d/i" id="article-3-7-d-i"><Pnumber>i</Pnumber><P4para><Text>by the date specified on the final notice;</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/3/7/d/ii" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/3/7/d/ii" id="article-3-7-d-ii"><Pnumber>ii</Pnumber><P4para><Text>if not in accordance with paragraph (i), within 30 days following the date on the notice to the person that payments of a tax credit under section 24(4) of the 2002 Act have ceased due to the person's failure to make the declaration by the date specified in the final notice; day,</Addition></Text></P3para></P3><Text><Addition ChangeId="key-d157358b18cc4c8eeadde77cf994268e-1719237811286" CommentaryRef="key-d157358b18cc4c8eeadde77cf994268e">if there is a good reason to do may, instead of cancelling the tax credit closure notice, treat that notice as if it were a migration notice issued to that person and as if the deadline day in the tax credit closure notice were the and Commencement No. 21 and 23 and Transitional and Transitory Provisions (Amendment)) Order 2019 or article 4 (savings) of the Welfare Reform (Northern Ireland) Order 2015 (Commencement No. 13 and Savings and Transitional Provisions and Commencement No. 8 and Transitional and Transitory Provisions (Amendment)) Order 2019 applies,</Addition></Text></Para></ListItem></UnorderedList><Text><Addition ChangeId="key-d157358b18cc4c8eeadde77cf994268e-1719237811286" CommentaryRef="key-d157358b18cc4c8eeadde77cf994268e">and the reference in paragraph (1) to a person who is entitled to a tax credit includes a person who is treated as being so entitled by virtue of regulation 11(1) (ongoing awards of tax credits) of the Universal Credit (Transitional Provisions) Regulations 2014 or regulation 9(1) (ongoing awards of tax credits) of the Universal Credit (Transitional Provisions) Regulations (Northern Ireland) with this article during a tax year, the amount of the tax credit to which the person is entitled for that tax year is to be calculated in accordance with the Tax Credits Act 2002 and regulations made under that Act as modified by Schedule 1 (modification of tax credits legislation (finalisation of tax credits)) to the Universal Credit (Transitional Provisions) Regulations 2014 or Schedule 1 (modification of tax credits legislation (finalisation of tax credits)) to the Universal Credit (Transitional Provisions) Regulations (Northern Ireland) 2016 in the same way as as made during the relevant period by a UC single claimant or by either of two UC joint claimants who has or have made a claim for universal credit under sub-paragraph (a) or (g) of article 4(2) of the No. 9 Order <CommentaryRef Ref="c23550231"/> and any award that is made in respect of the claim.</Text></P2para></P2><P2 paragraph (6)(b);</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/4/13/a/iii" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/4/13/a/iii" id="article-4-13-a-iii"><Pnumber>iii</Pnumber><P4para><Text>in relation to universal credit, has the same meaning as in Part 1 of the Act, save as mentioned in paragraph (2) and (6)(a);</Text></P4para></P4></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/4/13/b" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/4/13/b" id="article-4-13-b"><Pnumber>b</Pnumber><P3para><Text>“<Term id="term-relevant-period">relevant period</Term>” means, in relation to a claim for universal credit within paragraph (6)(a), any UC claim period, and any period subsequent to any UC claim period in respect of which the claimant is entitled to an award of universal credit in respect of the claim;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/4/13/c" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/4/13/c" id="article-4-13-c"><Pnumber>c</Pnumber><P3para><Text>“<Term id="term-uc-claim-period">UC claim period</Term>” means a period when—</Text><P4 id="article-4-13-c-i"><Pnumber>i</Pnumber><P4para><Text>a claim for universal credit within paragraph (6)(a) has been made but a decision has not yet been made on the claim; or</Text></P4para></P4><P4 id="article-4-13-c-ii"><Pnumber>ii</Pnumber><P4para><Text>a decision has been made that the claimant is not entitled to universal credit and—</Text><P5 Ref="c23550241"/>, whether on an application made for that purpose or on the Secretary of State's own initiative; or</Text></P5para></P5><P5 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/4/13/c/ii/bb" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/4/13/c/ii/bb" id="article-4-13-c-ii-bb"><Pnumber>bb</Pnumber><P5para><Text>the claimant has appealed against that decision to the First-tier Tribunal and that appeal, or any subsequent appeal to the Upper Tribunal or a court, has not yet been finally determined;</Text></P5para></P5></P4para></P4></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2019/167/article/4/13/d" IdURI="http://www.legislation.gov.uk/id/uksi/2019/167/article/4/13/d" id="article-4-13-d"><Pnumber>d</Pnumber><P3para><Text>the Universal Credit, Personal Independence Payment, Jobseeker's Allowance Article 2, which extends to Great Britain and Northern Ireland, commences section 33(1)(f) of the Welfare Reform Act 2012 (c. 5) (“<Term>the Act</Term>”), which abolishes child tax credit and working tax credit (“tax credit”), and the repeal of Part 1 of the Tax Credits Act 2002 (c. 21) (but not Schedule 1 or 3), by Part 1 of Schedule 14 to the Act, on 1st February 2019, subject to the savings referred to below.</Text></Para></BlockText></P><P><BlockText><Para><Text>2. Article 3 contains a saving for existing awards of a tax credit – i.e. one that has effect for a period that includes 31st January 2019.</Text></Para></BlockText></P><P><BlockText><Para><Text>3. Persons aged over state pension credit qualifying age may claim state pension credit and, from 1<Superior>st</Superior> February 2019, by virtue of the State Pension Credit (Additional Amount for Child or Qualifying Young Person) (Amendment) Regulations 2018 (S.I. 2018/676) for Great Britain and the State Pension Credit (Additional Amount for Child or Qualifying Young Person) (Amendment) Regulations (Northern Ireland) (S.R. 2018/135) for Northern Ireland, state pension credit may include an additional amount where a person is responsible for a child or a qualifying young person.</Text></Para></BlockText></P><P><BlockText><Para><Text>4. Meanwhile, persons aged under state pension qualifying age may claim universal credit. Currently, mixed-age couples (where one member of a couple is aged over that age and one is aged below it) may claim universal credit or state pension credit but with effect from 15th May 2019, mixed-age couples will not be able to make new claims for state pension credit and must claim universal credit – see below for cases where a person may not claim universal credit.</Text></Para></BlockText></P><P><BlockText><Para><Text>5. Article 3, which extends to Great Britain and Northern Ireland, provides for savings in the following cases:</Text></Para></BlockText></P><P><BlockText><Para><Text>a) an award of child tax credit or working tax credit (“tax credit”) that has effect for a period that includes 31st January 2019 (paragraph (2));</Text></Para></BlockText></P><P><BlockText><Para><Text>b) an award of a tax credit where the period for which it has effect begins on or after 1st February 2019 and where the claim for the award is made by a single claimant, couple or polygamous unit (<Emphasis>see</Emphasis> S.I. 2003/742) where the single claimant, both members of the couple or all members of the polygamous unit could claim universal credit (“UC”) and meet the  “UC age condition” (<Emphasis>see</Emphasis> below), ignoring any restrictions on claiming UC in relevant secondary legislation (paragraph (3)) (<Emphasis>see</Emphasis> below for details of the current restrictions);</Text></Para></BlockText></P><P><BlockText><Para><Text>c) an award of child tax credit or working tax credit where the period for which it has effect begins on or after 1st February 2019 and where the claim is made by a couple or a polygamous unit where only one member of the couple, or only some members of the polygamous unit, could claim UC and meet the UC age condition, and where the member or members who could claim UC and meet that condition cannot claim UC by virtue of restrictions in relevant secondary legislation (paragraph (4));</Text></Para></BlockText></P><P><BlockText><Para><Text>d) an award of child tax credit where the period for which it has effect begins on or after 1st February 2019 and where the claimant has an award of working tax credit on the date that the claim for that award is made (and vice versa) (paragraph (5)(a) and (b));</Text></Para></BlockText></P><P><BlockText><Para><Text>e) an award of child tax credit or working tax credit, where the period for which it has effect begins on or after 1st February 2019, and where the claimant had an award of the same type of tax credit for the previous tax year to the tax year for which the claim for the award is made (paragraph (5)(c));</Text></Para></BlockText></P><P><BlockText><Para><Text>f) an award of a tax credit that had effect for a period that ended on or before 30th January 2019 (paragraph (9)).</Text></Para></BlockText></P><P><BlockText><Para><Text>6. In paragraph 5(b) above, the  “<Term>age condition for UC</Term>” means the condition set out in section 4(1)(b) of the Act for Great Britain or Article 9(1)(b) of the Welfare Reform (Northern Ireland) Order 2015 (S.I. 2015/2006 (N.I.)) for Northern Ireland, subject to any exception in any instrument made under the Act or Order.</Text></Para></BlockText></P><P><BlockText><Para><Text>7. For claimants as referred to in paragraph 5(b) above, article 7 of the Welfare Reform Act 2012 (Commencement No. 23 and Transitional and Transitory Provisions) Order 2015 (S.I. 2015/634 (C. 32)) (“No. 23 Order”) for Great Britain, and article 24 of the Welfare Reform (Northern Ireland) Order 2015 (Commencement No. 8 and Transitional and Transitory Provisions) Order 2017 (S.R. 2017 No.190 (C. 11)) (“No. 8 Order”) prevent a person who is able to make a claim for UC from claiming a tax credit, subject to specified exceptions.</Text></Para></BlockText></P><P><BlockText><Para><Text>8. There are currently exceptions from the need to claim universal credit in the case of:</Text></Para></BlockText></P><P><BlockText><Para><Text>a) a claimant who has recently had an award of certain benefits with a severe disability premium (<Emphasis>see </Emphasis>S.I. 2019/10 for Great Britain and S.R. 2019/2 for Northern Ireland), and, under article 4(11) of this Order for Great Britain, and article 2(11) of the Welfare Reform (Northern Ireland) Order 2015 (Commencement No. 14 and Savings and Transitional Provisions) Order 2019 (S.R. 2019/7 (C. 2)) (“<Term>2019 Order</Term>”) for Northern Ireland;</Text></Para></BlockText></P><P><BlockText><Para><Text>b) a claimant who is a  “frontier worker” (e.g. a person who does not reside in Great Britain or Northern Ireland but who works there, for example in the exercise of rights under European Union law).</Text></Para></BlockText></P><P><BlockText><Para><Text>In these cases it will be possible for a claimant to make a claim for a tax credit.</Text></Para></BlockText></P><P><BlockText><Para><Text>9. Paragraphs (6) and (7) of article 3 contain provisions, for the purposes of paragraph (5) of that article, that treat a person as having, or having had, an award of a tax credit in circumstances where an award for the previous tax year is in the course of being finalised.</Text></Para></BlockText></P><P><BlockText><Para><Text>10. Article 4 of this Order, which extends to Great Britain only, commences the provisions (“UC provisions”) in Part 1 of the Act that relate to universal credit and the abolition of income-related employment and support allowance and income-based jobseeker's allowance for the cases set out in that article.</Text></Para></BlockText></P><P><BlockText><Para><Text>11. Article 4(1) and (2) bring into force the provisions relating to universal credit (listed in Schedule 2 to the Welfare Reform 2012 (Commencement No 9 and Transitional and Transitory Provisions and Commencement No 8 and Savings and Transitional Provisions (Amendment)) Order 2013 (S.I. 2013/983 (C. 41)) (“No. 9 Order”) in relation to a claim for universal credit that is made on or after 1st February 2019 with respect to a period that begins on or after that date, where the claimant (in the case of joint claimants, either of them) resides outside Great Britain. This includes a crown servant or a member of Her Majesty's forces posted overseas.</Text></Para></BlockText></P><P><BlockText><Para><Text>12. Article 4(5) and (6) brings into force the provisions of the Act relating to the abolition of income-related employment and support allowance and income-based jobseeker's allowance in relation to a claim for universal credit, employment and support allowance or jobseeker's allowance that is made on or after 1st February 2019 with respect to a period that begins on or after that date, where the claimant (in the case of joint claimants, either of them) resides outside Great Britain.</Text></Para></BlockText></P><P><BlockText><Para><Text>13. Article 4(10) applies provisions in article 7 of the No. 23 Order to the above commencement of the UC provisions such that a claim may not be made for housing benefit, income support or a tax credit where under this Order a claim may be made for UC, subject to the exceptions in the article.</Text></Para></BlockText></P><P><BlockText><Para><Text>14. Article 4(11) provides that a claim for universal credit may not be made by a single claimant or joint claimants where the claimant or each of the joint claimants is a  “frontier worker”.</Text></Para></BlockText></P><P><BlockText><Para><Text>15. Article 5 of the Order, which extends to Great Britain only, makes changes, consequential on articles 2 to 4, to the No. 9 Order, the Commencement No. 21 and Transitional and Transitory Provisions) Order 2015 (S.I. 2015/33) (“No. 21 Order”) and the No. 23 Order in order to:</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>create an exception to the bar in the No. 21 and 23 Orders on a person claiming housing benefit, income support or a tax credit, in the case of a claim for one of these benefits by a  “frontier worker”, consequent on the restriction on claiming UC in article 4(11) of this Order;</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>amend the No. 9 Order to enable a frontier worker to make a claim for income-related employment and support allowance or income-based jobseeker's allowance, given the existence of that restriction on claiming universal credit;</Text></Para></ListItem><ListItem NumberOverride="c"><Para><Text>remove the general exception, in the No. 21 and 23 Orders, that permitted claims for tax credits by mixed-age couples (where one member is aged over state pension credit qualifying age and the other aged below it) – this does not affect the exception in (a) above.</Text></Para></ListItem></OrderedList></BlockText></P><P><BlockText><Para><Text>16.
