Coming into force in accordance with regulation 1
The Secretary of State makes these Regulations in exercise of the powers conferred by section 8(1) of, and paragraph 21(b) of Schedule 7 to, the European Union (Withdrawal) Act 2018(1).
The requirements of paragraph 3(2) of Schedule 7 to the European Union (Withdrawal) Act 2018 (relating to the appropriate Parliamentary procedure for these Regulations) have been satisfied.
1.—(1) These Regulations may be cited as the Livestock (Records, Identification and Movement) (Amendment) (Northern Ireland) (EU Exit) Regulations 2019 and come into force on exit day.
(2) These Regulations extend to Northern Ireland only.
2. In the Cattle Identification (Enforcement) Regulations (Northern Ireland) 1998(2), in regulation 4(2)(f), for “a representative of the European Commission acting for the purposes of the Council Regulation or any other person he considers necessary for the enforcement of that Regulation or these Regulations” substitute “any person he considers necessary”.
3.—(1) The Cattle Identification (No.2) Regulations (Northern Ireland) 1998(3) are amended as follows.
(2) In regulation 2, in the definition of “member State”, omit “other than the United Kingdom”.
(3) Omit regulation 8.
(4) In regulation 14(2)(f), for “a representative of the European Commission acting for the purposes of the Council Regulation or any other person he considers necessary for the enforcement of these Regulations” substitute “any person he considers necessary”.
4. In the Cattle Identification (Notification of Births, Deaths and Movements) Regulations (Northern Ireland) 1999(4), in regulation 11(2)(f), for “a representative of the European Commission acting for the purposes of the Council Regulation or any other person he considers necessary for the enforcement of these Regulations” substitute “any person he considers necessary”.
5.—(1) The Cattle Passport Regulations (Northern Ireland) 1999(5) are amended as follows.
(2) In regulation 2(2)—
(a)omit the definition of “the Council Regulation”;
(b)in the definition of “member State”, omit “, other than the United Kingdom”.
(3) Omit regulation 2(3) and (4).
(4) In regulations 3(1), (3) and 6(1), for “another part of the European Community” substitute “Great Britain, the Isle of Man or any of the Channel Islands”.
(5) For regulation 5 substitute—
“5. Any person who consigns any animal out of Northern Ireland to Great Britain, the Isle of Man or any of the Channel Islands commits an offence unless the animal is accompanied by a cattle passport which is signed in the appropriate place in accordance with Article 6.1 of Commission Regulation (EC) No. 911/2004 and contains the information about the animal specified in that Article.”.
(6) In regulation 7, omit “In accordance with Article 6.2 of the Council Regulation,” and “a member State,”.
(7) In regulation 8—
(a)in the heading, omit “other member States,”;
(b)in paragraph (1), omit “a member State,”.
(8) In regulation 10(1), omit “in accordance with Article 6.4 of the Council Regulation”.
6.—(1) The Sheep and Goats (Records, Identification and Movement) Order (Northern Ireland) 2009(6) is amended as follows.
(2) In article 2(1)—
(a)in the definitions of “identification mark” and “method of identification”, for “another” substitute “a”;
(b)in the definition of “member State”, omit “other than the United Kingdom and does not include the Isle of Man and the Channel Islands”.
(3) In article 27, in the heading and in paragraphs (1) and (2), for “another” substitute “a”.
(4) In article 36(1)(d), for “another” substitute “a”.
7. In the Pigs (Records, Identification and Movement) Order (Northern Ireland) 2012(7), in article 11, omit “intra-Community trade or”.

These Regulations are made in exercise of the powers in the European Union (Withdrawal) Act 2018 (c.16) in order to address failures of domestic legislation to operate effectively and other deficiencies (in particular, under paragraphs (a), (d) and (g) of section 8(2) of the Act) arising from the withdrawal of the United Kingdom from the European Union.
These Regulations make amendments to subordinate legislation which applies to Northern Ireland that is concerned with the records, identification and movement of cattle, sheep, goats and pigs.
An impact assessment has not been produced for this instrument as no, or no significant, impact on the private or voluntary sector is foreseen.
