This statutory instrument was made under a procedure whereby it ceases to have effect at the end of the period of 28 days beginning with the day on which it was made unless, during that period, the instrument is approved by a resolution of each House of Parliament. It was not approved by Parliament within that period and so has ceased to have effect.

For paragraph 3 substitute—

Electricity Act 19893

The Electricity Act 1989 M1 is amended as follows.

 In section 15(2) M2—

a

omit the “or” at the end of paragraph (a);

b

after paragraph (a) insert—

aa

an order under section 84C of that Act made in relation to a retained EU merger commitment if one or more persons who gave the commitment was engaged in the carrying on of activities authorised or regulated by a licence at the time the commitment was given; or

In section 43(3) M3—

a

at the end of paragraph (a), insert “ or ”;

b

omit paragraphs (c) and (d).

In section 56CB(1A)(b) M4, for “subsection (8A)” substitute “ subsections (8A), (8B) and (8C) ”.
