The Sexual Offences Act 2003 (Prescribed Police Stations) (England and Wales) (Amendment) Regulations 2019

The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 87(1)(a) and 138(4)(b) of the Sexual Offences Act 2003(1).

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Sexual Offences Act 2003 (Prescribed Police Stations) (England and Wales) (Amendment) Regulations 2019 and, subject to paragraphs (2) to (4), come into force on 1st August 2019.

(2) The entry relating to Lincoln Police Station inserted by the Schedule has effect from 16th September 2019.

(3) The entry relating to Lymington Neighbourhood Police Station inserted by the Schedule has effect from 15th October 2019.

(4) The entry relating to Penrith Police Station inserted by the Schedule has effect from 25th November 2019.

(5) In these Regulations, “the 2018 Regulations” means the Sexual Offences Act 2003 (Prescribed Police Stations) (England and Wales) Regulations 2018(2).

Amendment of prescribed police stations

2.  The entries in the Schedule to the 2018 Regulations specified in the first column of the table in the Schedule to these Regulations are amended as specified in the second column.

Transitory provision

3.—(1) The police station at Hunter Lane, Penrith, CA11 7UT continues to be prescribed in relation to the police area of Cumbria for the purposes of section 87(1)(a) of the Sexual Offences Act 2003 until 29th November 2019, notwithstanding the amendment to the 2018 Regulations relating to Penrith Police Station.

(2) The police station at West Parade, Lincoln, LN1 1YP continues to be prescribed in relation to the police area of Lincolnshire for the purposes of section 87(1)(a) of the Sexual Offences Act 2003 until 30th October 2019, notwithstanding the amendment to the 2018 Regulations relating to Lincoln Police Station.

(3) The police station at Southampton Road, Lymington, SO41 9GH continues to be prescribed in relation to the police area of Hampshire for the purposes of section 87(1)(a) of the Sexual Offences Act 2003 until 30th October 2019, notwithstanding the amendment to the 2018 Regulations relating to Lymington Police Station.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations, which extend to England and Wales only, amend the Sexual Offences Act 2003 (Prescribed Police Stations) (England and Wales) Regulations 2018 (“the 2018 Regulations”).

The Sexual Offences Act 2003 (“the 2003 Act”) imposes notification requirements on offenders convicted of certain sex offences. These offenders are called “relevant offenders”. The 2003 Act requires relevant offenders to notify certain personal information to the police. Section 87(1) of the 2003 Act provides that relevant offenders give such notifications by attending at any police station in the relevant offender’s local police area which is prescribed in regulations. The 2018 Regulations prescribe those police stations in England and Wales.

These Regulations make changes to the list of police stations prescribed in 12 of the local police areas.

An impact assessment has not been produced for this instrument as no impact on the private, voluntary or public sector is foreseen.
