The Reserve Forces Act 1996 (Isle of Man) (Amendment) Regulations 2018

The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 83 and 84 of the Reserve Forces Act 1996(1), as it has effect in the Isle of Man(2).

Citation and commencement

1.  These Regulations may be cited as the Reserve Forces Act 1996 (Isle of Man) (Amendment) Regulations 2018 and come into force on 2nd October 2018.

Amendment of the Reserve Forces Act 1996 (Isle of Man) Regulations 2010

2.—(1) The Reserve Forces Act 1996 (Isle of Man) Regulations 2010(3) are amended as follows.

(2) In regulation 2—

(a) after “the Reserve Forces (Call-out and Recall) (Financial Assistance) Regulations 2005;”, omit “and”; and

(b) after “the Reserve Forces (Provision of Information by Persons Liable to be Recalled) (Amendment) Regulations 2005”, insert—

“; and

the Reserve Forces (Call-out and Recall) (Financial Assistance) (Amendment) Regulations 2015(4)”.

(3) In the Schedule, after paragraph 9 insert—

“PART 5 MODIFICATIONS OF SI 2015/460

10.   In regulation 3(1)(c), for the definition of “undertaking” inserted by that sub-paragraph, substitute—

““undertaking” means—

(a)

a body corporate or partnership; or

(b)

an unincorporated association carrying on a trade or business, with or without a view to profit.”.

11.   In regulation 6, for the words “27th March 2015” substitute “2nd October 2018”.”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations apply to the Isle of Man, subject to modifications, the Reserve Forces (Call-out and Recall) (Financial Assistance) (Amendment) Regulations 2015 (S.I. 2015/460) (“the 2015 Regulations”). The 2015 Regulations amend the Reserve Forces (Call-out and Recall) (Financial Assistance) Regulations 2005 (S.I. 2005/859) (“the 2005 Regulations”). Regulation 2 applies the 2015 Regulations to the Isle of Man by amending the Reserve Forces Act 1996 (Isle of Man) Regulations 2010 (S.I. 2010/2643), which apply to the Isle of Man, subject to modifications, regulations made under the Reserve Forces Act 1996 (c.14).

The Reserve Forces Act 1996 was extended to the Isle of Man, with modifications, by the Reserve Forces Act 1996 (Isle of

Man) Order 2010 (S.I. 2010/2470), as amended by the Reserve Forces Acts 1980 and 1996 (Isle of Man) (Amendment) Order 2016 (S.I. 2016/746).
