5.—(1) The number of students at the school for whom a local authority maintain—
(a)a statement of special educational needs pursuant to section 324 of the 1996 Act(1); or
(b)an education, health and care plan under section 37 of the Children and Families Act 2014(2).
(2) The number of students at the school who—
(a)are not within sub-paragraph (1); but
(b)have been identified as having special educational needs.

Amendments to section 324 were made by section 9 of the Special Educational Needs and Disability Act 2001 (c. 10) and paragraph 7(2) of the Local Education Authorities and Children’s Services Authorities (Integration of Functions) Order 2010 (S.I. 2010/1158).

Explanatory Memorandum
Explanatory Memorandum sets out a brief statement of the purpose of a Statutory Instrument and provides information about its policy objective and policy implications. They aim to make the Statutory Instrument accessible to readers who are not legally qualified and accompany any Statutory Instrument or Draft Statutory Instrument laid before Parliament from June 2004 onwards.
