RestrictStartDate="2020-12-31"><Title>Interpretation</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/3" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/3" id="regulation-3"><Pnumber>3</Pnumber><P1para><Text>In these Regulations—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term id="term-the-1974-act">the 1974 Act</Term>” means the Health and Safety at Work etc. Act 1974 <CommentaryRef Ref="c23331071"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-the-1978-order">the 1978 Order</Term>” means the Health and Safety at Work (Northern Ireland) Order 1978 <CommentaryRef Ref="c23331081"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-rams">RAMS</Term>” means Regulation <Citation URI="http://www.legislation.gov.uk/european/regulation/2008/0765" id="c00001" Class="EuropeanUnionRegulation" Year="2008" Number="765">(EC) 765/2008</Citation> of the European Parliament and of the Council of 9<Superior/>July 2008 setting out the requirements for accreditation and market surveillance relating to the marketing of products and repealing Regulation <Citation URI="http://www.legislation.gov.uk/european/regulation/19935/0339" id="c00002" Class="EuropeanEconomicCommunityRegulation" Year="19935" Number="339">(EEC) No 339/935</Citation> <CommentaryRef Ref="c23331091"/>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-regulation-2016424eu">Regulation 2016/424/EU</Term>” means Regulation (EU) 2016/424 of the European Parliament and of the Council of 9 March 2016 on cableway installations and repealing Directive <Citation URI="http://www.legislation.gov.uk/european/directive/2000/0009" id="c00003" Class="EuropeanUnionDirective" Year="2000" Number="9">2000/9/EC</Citation> <CommentaryRef Ref="c23331101"/>;</Text></Para></ListItem><ListItem><Para><Text> <Addition ChangeId="key-eea1662902d27277d6008077398ad9bc-1652196683387" CommentaryRef="key-eea1662902d27277d6008077398ad9bc">“</Addition><Term><Addition ChangeId="key-eea1662902d27277d6008077398ad9bc-1652196683387" CommentaryRef="key-eea1662902d27277d6008077398ad9bc">approved body</Addition></Term><Addition ChangeId="key-eea1662902d27277d6008077398ad9bc-1652196683387" CommentaryRef="key-eea1662902d27277d6008077398ad9bc">” means a conformity assessment body— </Addition></Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="(a)"><Para><Text><Addition ChangeId="key-eea1662902d27277d6008077398ad9bc-1652196683387" CommentaryRef="key-eea1662902d27277d6008077398ad9bc">which has been approved by the Secretary of State under Article 22 of Regulation 2016/424/EU; or</Addition></Text></Para></ListItem></OrderedList><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="(b)"><Para><Text><Addition ChangeId="key-eea1662902d27277d6008077398ad9bc-1652196683387" CommentaryRef="key-eea1662902d27277d6008077398ad9bc">which was a notified body under these Regulations immediately before  IP completion day;</Addition></Text></Para></ListItem></OrderedList></ListItem><ListItem><Para><Text>“<Term id="term-authorised-cableway-installation">authorised cableway installation</Term>” means a cableway installation which has been given a stage 1 or stage 2 authorisation or both;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-cableway-installation">cableway installation</Term>” has the meaning given by Article 3(1) of Regulation 2016/424/EU;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-cableway-installation-documentation">cableway installation documentation</Term>” means the documentation concerning the characteristics of the cableway installation referred to in Article 9(2) of Regulation 2016/424/EU;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-conformity-assessment-body">conformity assessment body</Term>” has the meaning given by Article 3(23) of Regulation 2016/424/EU;</Text></Para></ListItem><ListItem><Para><Text> <Addition ChangeId="key-9d6017d0b910b29451a84f76711175dd-1652196798967" CommentaryRef="key-9d6017d0b910b29451a84f76711175dd">“</Addition><Term><Addition ChangeId="key-9d6017d0b910b29451a84f76711175dd-1652196798967" CommentaryRef="key-9d6017d0b910b29451a84f76711175dd">declaration of conformity</Addition></Term><Addition ChangeId="key-9d6017d0b910b29451a84f76711175dd-1652196798967" CommentaryRef="key-9d6017d0b910b29451a84f76711175dd">” means the declaration of conformity referred to in Article 19 of Regulation 2016/424/EU;</Addition> </Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-distributor">distributor</Term>” has the meaning given by Article 3(16) of Regulation 2016/424/EU;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-economic-operator">economic operator</Term>” has the meaning given by Article 3(17) of Regulation 2016/424/EU;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-entry-into-service">entry into service</Term>” has the meaning given by Article 3(12) of Regulation 2016/424/EU;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-essential-requirements">essential requirements</Term>” means the essential requirements set out in Annex II to Regulation 2016/424/EU and required to be met under Article 6 of that Regulation;</Text></Para></ListItem><ListItem><Para><Text><CommentaryRef Ref="key-5bf1d903d303c2f774395c2fad541cce"/>...</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-the-executive">the Executive</Term>” means—</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>in Great Britain, the Health and Safety Executive <CommentaryRef Ref="c23331111"/>; and</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>in Northern Ireland, the Health and Safety Executive for Northern Ireland <CommentaryRef Ref="c23331121"/>;</Text></Para></ListItem></OrderedList></ListItem><ListItem><Para><Text>“<Term id="term-importer">importer</Term>” has the meaning given by Article 3(15) of Regulation 2016/424/EU;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-main-contractor">main contractor</Term>” means a person who:</Text></Para><OrderedList Type="alpha" Decoration="parens"><ListItem NumberOverride="a"><Para><Text>commissions the construction or modification of a cableway installation; or</Text></Para></ListItem><ListItem NumberOverride="b"><Para><Text>constructs or modifies a cableway installation which that person intends to put into service;</Text></Para></ListItem></OrderedList></ListItem><ListItem><Para><Text>“<Term id="term-manufacturer">manufacturer</Term>” has the meaning given by Article 3(13) of Regulation 2016/424/EU;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-modification">modification</Term>” means any work in relation to a cableway installation (including any work in relation to the characteristics, subsystems or safety components of such installation) which could materially affect the capability, capacity or safety of the cableway installation;</Text></Para></ListItem><ListItem><Para><Text><CommentaryRef Ref="key-b006ae8e70afd668a85e139067d31a5f"/>...</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-operator">operator</Term>” in relation to a cableway installation means a person who, for the time being has, or is intending to have, management of that installation;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-regulatory-provisions">Regulatory Provisions</Term>” means these Regulations, Regulation 2016/424/EU and RAMS;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-safe">safe</Term>” in relation to a cableway installation, or a subsystem and safety component incorporated or to be incorporated into a cableway installation, means that it is not liable to endanger the health or safety of persons or property, when properly installed, maintained and operated in accordance with its intended purpose;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-safety-analysis">safety analysis</Term>” means the safety analysis required to be carried out under Article 8 of Regulation 2016/424/EU;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-safety-component">safety component</Term>” has the meaning given by Article 3(4) of Regulation 2016/424/EU;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-safety-report">safety report</Term>” means the report setting out the results of the safety analysis required under Article 8(5) of Regulation 2016/424/EU;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-stage-1-authorisation">stage 1 authorisation</Term>” means an authorisation of work for the construction or modification of a cableway installation given by the Secretary of State under regulation 8(1);</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-stage-2-authorisation">stage 2 authorisation</Term>” means an authorisation for the putting into service of a cableway installation given by the Secretary of State under regulation 8(3);</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-subsystem">subsystem</Term>” has the meaning given by Article 3(2) of Regulation 2016/424/EU;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-technical-file">technical file</Term>” means a file relating to a cableway installation which contains the safety report, the  <Substitution ChangeId="key-3593ed7309de7e026bae19909033f5b5-1652197892910" CommentaryRef="key-3593ed7309de7e026bae19909033f5b5">declaration</Substitution>  of conformity and other documents relating to the conformity of subsystems and safety components as well as the documentation concerning the characteristics of the cableway installation as referred to in Article 9(2) of Regulation 2016/424/EU;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-writing">writing</Term>” includes any text transmitted using electronic communications that is received, or accessible by the person to whom it is sent, in legible form.</Text></Para></ListItem></UnorderedList></P1para></P1></P1group><P1group RestrictStartDate="2018-07-30"><Title>Scope</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/4" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/4" id="regulation-4"><Pnumber>4</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/4/1" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/4/1" id="regulation-4-1"><Pnumber>1</Pnumber><P2para><Text>The cableway installations listed in the Schedule are categorised as historic, cultural or heritage installations for the purposes of point (b) of Article 2(2) of Regulation 2016/424/EU.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/4/2" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/4/2" id="regulation-4-2"><Pnumber>2</Pnumber><P2para><Text>The provisions of Parts 2 to 4 of these Regulations do not apply to the cableway installations referred to in paragraph 1, unless significant changes are made in their design or construction, including subsystems or safety components specifically designed for them.</Text></P2para></P2></P1para></P1></P1group></Part><Part           <Strong>PART 2</Strong>
        </Number><Title>General Requirements</Title><P1group RestrictStartDate="2018-07-30"><Title>Cableway installations: duties of the main contractor</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/5" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/5" id="regulation-5"><Pnumber>5</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/5/1" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/5/1" id="regulation-5-1"><Pnumber>1</Pnumber><P2para><Text>A person must not carry out or permit to be carried out works for the construction or modification of a cableway installation otherwise than under and in accordance with a stage 1 authorisation.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/5/2" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/5/2" id="regulation-5-2"><Pnumber>2</Pnumber><P2para><Text>The main contractor is responsible for carrying out the safety analysis and preparing the safety report required under Article 8 of Regulation 2016/424/EU.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/5/3" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/5/3" the purposes of paragraph (1), a stage 1 authorisation includes a stage 1 authorisation given by the Secretary of State under regulation 13(1) of the Cableway Installations Regulations 2004 before the date on which these Regulations come into force.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2018-07-30"><Title>Cableway installations: putting into service</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/6" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/6" id="regulation-6"><Pnumber>6</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/6/1" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/6/1" id="regulation-6-1"><Pnumber>1</Pnumber><P2para><Text>A person must not put into service a cableway installation otherwise than under and in accordance with a stage 2 authorisation.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/6/2" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/6/2" id="regulation-6-2"><Pnumber>2</Pnumber><P2para><Text>For the purposes of this regulation, a cableway installation is put into service on its entry into service and this includes when it first enters service following the completion of works for its modification for which a stage 1 authorisation was required.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/6/3" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/6/3" id="regulation-6-3"><Pnumber>3</Pnumber><P2para><Text>For the purposes of paragraph (1), a stage 2 authorisation includes a stage 2 authorisation given by the Secretary of State under regulation 13(3) of the Cableway Installations Regulations 2004 before the date on which these Regulations come into force.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2018-07-30"><Title>Cableway installations: operation</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/7" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/7" id="regulation-7"><Pnumber>7</Pnumber><P1para><Text>The operator of a cableway installation must at all times whilst the cableway installation remains in service—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/7/a" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/7/a" id="regulation-7-a"><Pnumber>a</Pnumber><P3para><Text>keep a copy of the technical file at the cableway installation; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/7/b" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/7/b" id="regulation-7-b"><Pnumber>b</Pnumber><P3para><Text>ensure that the cableway installation complies with the conditions set out in the safety report and such conditions (if any) as are imposed in relation to its entry into service by the Secretary of State under regulation 15(3).</Text></P3para></P3></P1para></P1></P1group></Part><Part DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/part/3" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/part/3" NumberOfProvisions="12" id="part-3" RestrictStartDate="2020-12-31"><Number><Strong>PART 3</Strong></Number><Title>Authorisation Procedures and  <Substitution ChangeId="key-07e86ddd8d2dac570614a9146722338f-1652196541701" CommentaryRef="key-07e86ddd8d2dac570614a9146722338f">Approved</Substitution>  Bodies</Title><P1group RestrictStartDate="2018-07-30"><Title>Authorisation by the Secretary of State</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/8" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/8" id="regulation-8"><Pnumber>8</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/8/1" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/8/1" id="regulation-8-1"><Pnumber>1</Pnumber><P2para><Text>The Secretary of State must authorise (or refuse to authorise) works for the construction or modification of a cableway installation in accordance with this Part.</Text></P2para></P2><P2 CommentaryRef="key-683f301ae31d3b4d80959a9a835547ed">approval</Substitution>  if the conditions set out in paragraphs (3) and (4) are met.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/10/3" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/10/3" id="regulation-10-3"><Pnumber>3</Pnumber><P2para><Text>The first condition is that the conformity assessment body has submitted an application to the Secretary of State to be  <Substitution 2016/424/EU.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/10/4" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/10/4" id="regulation-10-4"><Pnumber>4</Pnumber><P2para><Text>The second condition is that the Secretary of State is satisfied that the conformity assessment body meets the requirements of Article 26 of Regulation 2016/424/EU.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/10/5" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/10/5" id="regulation-10-5"><Pnumber>5</Pnumber><P2para><Text>When deciding whether to  <Substitution ChangeId="key-aa5692ffa06912baa7f242e10ed27721-1652201870303" CommentaryRef="key-aa5692ffa06912baa7f242e10ed27721">approve</Substitution>  a conformity assessment body that qualifies for  <Substitution ChangeId="key-59efe456ed916815e19374596e67cddc-1652201939953" CommentaryRef="key-59efe456ed916815e19374596e67cddc">approval</Substitution>, the Secretary of State may—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/10/5/a" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/10/5/a" id="regulation-10-5-a"><Pnumber>a</Pnumber><P3para><Text>have regard to any other matter that appears to the Secretary of State to be relevant; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/10/5/b" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/10/5/b" id="regulation-10-5-b"><Pnumber>b</Pnumber><P3para><Text>set conditions that the conformity assessment body must meet including such conditions that are to apply upon or following the restriction, suspension or withdrawal of its status as  <Substitution ChangeId="key-9957a343fd1b1949a8ed37af8803b1f3-1652201989678" CommentaryRef="key-9957a343fd1b1949a8ed37af8803b1f3">an approved body</Substitution>.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/10/6" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/10/6" id="regulation-10-6"><Pnumber>6</Pnumber><P2para><Text>Subject to paragraph (7), if at any time it appears to the Secretary of State—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/10/6/a" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/10/6/a" id="regulation-10-6-a"><Pnumber>a</Pnumber><P3para><Text>that  <Substitution ChangeId="key-d533b279ffe422b77e7c731f06232759-1652202431507" CommentaryRef="key-d533b279ffe422b77e7c731f06232759">an approved body</Substitution>  no longer meets the requirements laid down in Article 26 of Regulation 2016/424/EU; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/10/6/b" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/10/6/b" id="regulation-10-6-b"><Pnumber>b</Pnumber><P3para><Text>that it is failing to meet its obligations,</Text></P3para></P3><Text>the Secretary of State may by written notice to that body specify a date on which its status as  <Substitution ChangeId="key-d533b279ffe422b77e7c731f06232759-1652202451150" CommentaryRef="key-d533b279ffe422b77e7c731f06232759">an approved body</Substitution>  will be restricted, suspended or withdrawn, as appropriate depending on the seriousness of the failure to meet those requirements or obligations.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/10/7" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/10/7" id="regulation-10-7"><Pnumber>7</Pnumber><P2para><Text>Before the Secretary of State restricts, suspends or withdraws the status of a conformity assessment body as  <Substitution ChangeId="key-86749b22b10740a6fc43a8c68d2d077f-1652202627702" CommentaryRef="key-86749b22b10740a6fc43a8c68d2d077f">an approved body</Substitution>  under paragraph (6) the Secretary of State must—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/10/7/a" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/10/7/a" id="regulation-10-7-a"><Pnumber>a</Pnumber><P3para><Text>give notice in writing to  <Substitution ChangeId="key-f412fb2cdb129f6a7390f4e517dafa50-1652263914481" CommentaryRef="key-f412fb2cdb129f6a7390f4e517dafa50">the approved body</Substitution>  that the Secretary of State intends to take such action;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/10/7/b" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/10/7/b" id="regulation-10-7-b"><Pnumber>b</Pnumber><P3para><Text>give  <Substitution ChangeId="key-f412fb2cdb129f6a7390f4e517dafa50-1652263945260" CommentaryRef="key-f412fb2cdb129f6a7390f4e517dafa50">the approved body</Substitution>  the opportunity to make representations within a period of 14 days beginning with the day on which such notice is given; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/10/7/c" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/10/7/c" id="regulation-10-7-c"><Pnumber>c</Pnumber><P3para><Text>consider any representation made within that period by  <Substitution ChangeId="key-f412fb2cdb129f6a7390f4e517dafa50-1652263972470" CommentaryRef="key-f412fb2cdb129f6a7390f4e517dafa50">the approved body</Substitution>  before making a decision on whether to take such action.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/10/8" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/10/8" id="regulation-10-8"><Pnumber>8</Pnumber><P2para><Text>Where the Secretary of State has taken action in respect of  <Substitution ChangeId="key-6edadf12728b24ad005cec0df231ffac-1652264020428" CommentaryRef="key-6edadf12728b24ad005cec0df231ffac">an approved body</Substitution>  under paragraph (6), or where  <Substitution ChangeId="key-6edadf12728b24ad005cec0df231ffac-1652264052600" CommentaryRef="key-6edadf12728b24ad005cec0df231ffac">an approved body</Substitution>  has ceased its activity as a conformity assessment body, the body must—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/10/8/a" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/10/8/a" id="regulation-10-8-a"><Pnumber>a</Pnumber><P3para><Text>on the request of the Secretary of State, transfer its files relating to the activities it has undertaken as  <Substitution ChangeId="key-6edadf12728b24ad005cec0df231ffac-1652264116717" CommentaryRef="key-6edadf12728b24ad005cec0df231ffac">an approved body</Substitution>  to  <Substitution ChangeId="key-931c10ab34fee88c85e8084a3215fd01-1652264980592" CommentaryRef="key-931c10ab34fee88c85e8084a3215fd01">another approved body</Substitution>, to the Secretary of State, or to the Executive;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/10/8/b" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/10/8/b" id="regulation-10-8-b"><Pnumber>b</Pnumber><P3para><Text>in the absence of a request under sub-paragraph (a), ensure that its files relating to the activities it has undertaken as <Substitution ChangeId="key-6edadf12728b24ad005cec0df231ffac-1652264157928" CommentaryRef="key-6edadf12728b24ad005cec0df231ffac">an approved body</Substitution>  are kept available for the Secretary of State and the Executive for a period of 10 years beginning on the day on which the relevant document was created.</Text></P3para></P3></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2020-12-31"><Title>United Kingdom Accreditation Service</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/11" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/11" id="regulation-11"><Pnumber>11</Pnumber><P1para><Text>The Secretary of State may authorise the United Kingdom Accreditation Service <CommentaryRef Ref="c23331131"/> to carry out the following activities on behalf of the Secretary of State–—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/11/a" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/11/a" id="regulation-11-a"><Pnumber>a</Pnumber><P3para><Text>assessing whether a conformity assessment body meets the requirements of Article 26 of Regulation 2016/424/EU; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/11/b" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/11/b" id="regulation-11-b"><Pnumber>b</Pnumber><P3para><Text>monitoring  <Substitution ChangeId="key-fb98de311233d7a4d62dde941b54154b-1652200571713" CommentaryRef="key-fb98de311233d7a4d62dde941b54154b">approved bodies in relation to their compliance with the requirements of Chapter 4</Substitution>  of Regulation 2016/424/EU.</Text></P3para></P3></P1para></P1></P1group><P1group RestrictStartDate="2020-12-31"><Title>Fees</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/12" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/12" id="regulation-12"><Pnumber>12</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/12/1" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/12/1" id="regulation-12-1"><Pnumber>1</Pnumber><P2para><Text>Subject to paragraph (2),  <Substitution ChangeId="key-bfb5e08526dfa95a2ed4b47c32928f4f-1652201435579" CommentaryRef="key-bfb5e08526dfa95a2ed4b47c32928f4f">an approved body</Substitution>  may charge such fees in connection with, or incidental to, carrying out its duties in relation to its functions as it may determine.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/12/2" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/12/2" id="regulation-12-2"><Pnumber>2</Pnumber><P2para><Text>The fees charged pursuant to paragraph (1) must not exceed the sum of the following—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/12/2/a" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/12/2/a" id="regulation-12-2-a"><Pnumber>a</Pnumber><P3para><Text>the sum of the costs incurred or to be incurred by  <Substitution ChangeId="key-096d1957bcbe1a467f1936cdec8bc794-1652201485472" CommentaryRef="key-096d1957bcbe1a467f1936cdec8bc794">the approved body</Substitution>  in carrying out the relevant work on behalf of the person commissioning the work; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/12/2/b" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/12/2/b" id="regulation-12-2-b"><Pnumber>b</Pnumber><P3para><Text>an amount on account of profit which is reasonable in the circumstances having regard to—</Text><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/12/2/b/i" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/12/2/b/i" id="regulation-12-2-b-i"><Pnumber>i</Pnumber><P4para><Text>the character and extent of the work done or to be done by  <Substitution ChangeId="key-096d1957bcbe1a467f1936cdec8bc794-1652201510410" CommentaryRef="key-096d1957bcbe1a467f1936cdec8bc794">the approved body</Substitution>  on behalf of the person commissioning the work, and</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/12/2/b/ii" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/12/2/b/ii" id="regulation-12-2-b-ii"><Pnumber>ii</Pnumber><P4para><Text>the commercial rate normally charged on account of profit for that work or similar work.</Text></P4para></P4></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/12/3" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/12/3" id="regulation-12-3"><Pnumber>3</Pnumber><P2para><Text>The Secretary of State may charge such reasonable fee in connection with, or incidental to, carrying out the Secretary of State's functions under this Part as the Secretary of State may determine.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/12/4" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/12/4" id="regulation-12-4"><Pnumber>4</Pnumber><P2para><Text>The power in paragraphs (1) and (3) includes the power to require the payment of a fee or a reasonable estimate of the fee, in respect of the work commissioned in advance of carrying out that work.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2018-07-30"><Title>Application for a stage 1 authorisation</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/13" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/13" id="regulation-13"><Pnumber>13</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/13/1" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/13/1" id="regulation-13-1"><Pnumber>1</Pnumber><P2para><Text>An application for a stage 1 authorisation must be made by the main contractor.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/13/2" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/13/2" id="regulation-13-2"><Pnumber>2</Pnumber><P2para><Text>An application for a stage 1 authorisation must be made in writing to the Secretary of State and accompanied by—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/13/2/a" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/13/2/a" id="regulation-13-2-a"><Pnumber>a</Pnumber><P3para><Text>the relevant fee determined in accordance with regulation 12(3); and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/13/2/b" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/13/2/b" installation documentation required to be submitted under paragraph (2) may be limited to matters relating to the modification and its repercussions on the cableway installation as a whole.</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2018-07-30"><Title>Application for a stage 2 authorisation</Title><P1 RestrictStartDate="2018-07-30"><Title>Granting of stage 1 and stage 2 authorisations</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/15" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/15" id="regulation-15"><Pnumber>15</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/15/1" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/15/1" id="regulation-15-1"><Pnumber>1</Pnumber><P2para><Text>The Secretary of State must grant a stage 1 authorisation if satisfied that—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/15/1/a" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/15/1/a" id="regulation-15-1-a"><Pnumber>a</Pnumber><P3para><Text>the requirements of Regulation 2016/424/EU are likely to be complied with both as regards the construction or modification of the cableway installation itself and as regards the subsystems or safety components incorporated into it; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/15/1/b" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/15/1/b" id="regulation-15-1-b"><Pnumber>b</Pnumber><P3para><Text>the cableway installation, when constructed or modified, including such subsystems or safety components, is likely to meet the essential requirements applicable to them and be safe.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/15/2" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/15/2" id="regulation-15-2"><Pnumber>2</Pnumber><P2para><Text>The Secretary of State must grant a stage 2 authorisation if satisfied that—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/15/2/a" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/15/2/a" id="regulation-15-2-a"><Pnumber>a</Pnumber><P3para><Text>the cableway installation has been designed and constructed in such a way as to comply with the requirements of Regulation 2016/424/EU;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/15/2/b" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/15/2/b" id="regulation-15-2-b"><Pnumber>b</Pnumber><P3para><Text>the cableway installation and the subsystem and safety components incorporated into it are not liable to endanger the health or safety of persons or property when properly maintained and operated in accordance with their intended purpose; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/15/2/c" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/15/2/c" id="regulation-15-2-c"><Pnumber>c</Pnumber><P3para><Text>the cableway installation has been constructed or modified in accordance with any measures specified in the safety report.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/15/3" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/15/3" id="regulation-15-3"><Pnumber>3</Pnumber><P2para><Text>The Secretary of State may grant a stage 1 authorisation or a stage 2 authorisation subject to compliance with such conditions as appear to the Secretary of State to be appropriate for the purposes of ensuring that the cableway installation complies with the essential requirements and is safe.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/15/4" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/15/4" id="regulation-15-4"><Pnumber>4</Pnumber><P2para><Text>The conditions referred to in paragraph (3) must include conditions specified in the safety report imposing restrictions on the operation of the cableway installation and conditions with regard to its servicing, supervision, adjustment and maintenance.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/15/5" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/15/5" id="regulation-15-5"><Pnumber>5</Pnumber><P2para><Text>The Secretary of State must consider any application for a stage 1 or stage 2 authorisation except where—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/15/5/a" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/15/5/a" id="regulation-15-5-a"><Pnumber>a</Pnumber><P3para><Text>the applicant has failed to make an application in relation to—</Text><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/15/5/a/i" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/15/5/a/i" id="regulation-15-5-a-i"><Pnumber>i</Pnumber><P4para><Text>a stage 1 authorisation that complies with regulation 13, or</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/15/5/a/ii" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/15/5/a/ii" id="regulation-15-5-a-ii"><Pnumber>ii</Pnumber><P4para><Text>a stage 2 authorisation that complies with regulation 14;</Text></P4para></P4></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/15/5/b" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/15/5/b" id="regulation-15-5-b"><Pnumber>b</Pnumber><P3para><Text>the documents submitted to the Secretary of State are not in English; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/15/5/c" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/15/5/c" id="regulation-15-5-c"><Pnumber>c</Pnumber><P3para><Text>the applicant has not submitted the fee which the Secretary of State requires to be submitted pursuant to regulation or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/25/1/b" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/25/1/b" id="regulation-25-1-b"><Pnumber>b</Pnumber><P3para><Text>requiring it to withdraw or recall the subsystem or safety component from that market.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/25/2" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/25/2" id="regulation-25-2"><Pnumber>2</Pnumber><P2para><Text>A notice served under paragraph (1) must be in writing and must specify the date by which the relevant economic operator must comply with it.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/25/3" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/25/3" id="regulation-25-3"><Pnumber>3</Pnumber><P2para><Text>Any notice served under paragraph (1) may be withdrawn by the Executive serving written notice on the relevant economic operator.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/25/4" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/25/4" id="regulation-25-4"><Pnumber>4</Pnumber><P2para><Text>Where a notice has been served on a relevant economic operator under paragraph (1), the relevant economic operator must comply with it.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/25/5" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/25/5" id="regulation-25-5"><Pnumber>5</Pnumber><P2para><Text>In this regulation, a  “<Term id="term-relevant-economic-operator">relevant economic operator</Term>” means any economic operator who has placed or made available, or who is proposing to place or make available on the market, a subsystem or safety component in relation to which there has been a finding of non-compliance as referred to in paragraph (1).</Text></P2para></P2></P1para></P1></P1group><P1group RestrictStartDate="2018-07-30"><Title>Defence of due diligence</Title><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/26" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/26" id="regulation-26"><Pnumber>26</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/26/1" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/26/1" id="regulation-26-1"><Pnumber>1</Pnumber><P2para><Text>Subject to the following provisions of this regulation, in any proceedings against any person (“P”) for an offence arising under or by virtue of these Regulations it is a defence for P to show that P took all reasonable steps and exercised all due diligence to avoid committing the offence.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/26/2" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/26/2" id="regulation-26-2"><Pnumber>2</Pnumber><P2para><Text>Where in any proceedings against P for such an offence the defence provided in paragraph (1) involves an allegation that the commission of the offence was due to—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/26/2/a" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/26/2/a" id="regulation-26-2-a"><Pnumber>a</Pnumber><P3para><Text>the act or default of another; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/26/2/b" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/26/2/b" id="regulation-26-2-b"><Pnumber>b</Pnumber><P3para><Text>reliance on information given by another,</Text></P3para></P3><Text>P is not, without the leave of the court, entitled to rely on the defence unless, within a period ending seven clear days before the hearing of the proceedings (or in Scotland, the trial diet), P has served a notice under paragraph (3) on the person bringing the proceedings.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/26/3" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/26/3" id="regulation-26-3"><Pnumber>3</Pnumber><P2para><Text>A notice under this regulation must give such information identifying, or assisting in the identification of, the person who committed the act or default or gave the information as is in the possession of P at the time P serves the notice.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/26/4" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/26/4" id="regulation-26-4"><Pnumber>4</Pnumber><P2para><Text>P is not entitled to rely on the defence provided by paragraph (1) by reason of P's reliance on information supplied by another, unless P shows that it was reasonable in all the circumstances for P to have relied on the information, having regard in particular—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2018/816/regulation/26/4/a" IdURI="http://www.legislation.gov.uk/id/uksi/2018/816/regulation/26/4/a" id="regulation-26-4-a"><Pnumber>a</Pnumber><P3para><Text>to the steps which P took, and those which might reasonably have been taken, for the purpose of verifying the information; (“Regulation 2016/424/EU”) and for related enforcement.</Text></Para></BlockText></P><P><BlockText><Para><Text>EU Regulation 2016/424 repeals and replaces Council Directive <Citation URI="http://www.legislation.gov.uk/european/directive/2000/0009" id="c00004" Class="EuropeanUnionDirective" Year="2000" Number="9">2000/9/EC</Citation> of the European Parliament and of the Council of 20th March 2000 relating to cableway installations designed to carry persons (OJ No L 106, 3.5.2000, p.21.); which was implemented in the United Kingdom by the Cableways Installations Regulations 2004 (S.I. 2004/129).</Text></Para></BlockText></P><P><BlockText><Para><Text>These Regulations revoke the Cableway Installations Regulations 2004 and the Cableway Installations (Amendment) Regulations 2004 (S.I. 2004/1230).</Text></Para></BlockText></P><P><BlockText><Para><Text>Part 1 contains preliminary provisions. Regulation 4 designates certain cableway installations that entered into service before 1 January 1986 (these are listed in the Schedule) as historic, heritage or cultural installations for the purposes of point (b) of Article 2(2) of Regulation 2016/424/EU (that Regulation does not apply to cableway installations which are so designated) and provides that Parts 2 to 4 of these Regulations do not apply to them.</Text></Para></BlockText></P><P><BlockText><Para><Text>Part 2 contains the general requirements regarding authorisation of cableway installations being constructed or modified and brought into service. Requirements in relation to conformity assessment of subsystems and safety components of cableway installations are contained in Regulation 2016/424/EU.</Text></Para></BlockText></P><P><BlockText><Para><Text>Part 3 sets out the authorisation procedures for cableway installations being brought into service. Regulation 9 designates the Secretary of State as the notifying authority for the United Kingdom. Regulation 10 gives the Secretary of State the power to appoint notified bodies for the purposes of Regulation 2016/424/EU, and sets out the process around that appointment. Regulation 11 gives the Secretary of State the power to appoint the United Kingdom Accreditation Authority to assess conformity assessment bodies, and to monitor notified bodies. Regulation 12 sets out the fees that may be charged by a notified body in connection with carrying out its functions. Regulations 13 to 16 set out the process for obtaining stage 1 authorisation (in respect of the construction or modification of a cableway installation) and stage 2 authorisation (in respect of entry into service of a cableway installation). Regulations 17 to 19 place an obligation on manufacturers, importers and distributors to provide the prescribed information in relation to safety components and subsystems in the English language.</Text></Para></BlockText></P><P><BlockText><Para><Text>The requirements and procedures set out in Parts 2 and 3 (with the exception of those in Regulations 17 to 19) give effect to obligations under Articles 5 – 10, and Chapter IV of Regulation 2016/424/EU for member States of the European Union to put in place such requirements and authorisation procedures. Regulations 17 to 19 give effect to requirements on member States to specify language requirements in Article 11 to 14 of Regulation 2016/424/EU.</Text></Para></BlockText></P><P><BlockText><Para><Text>Part 4 sets out the market surveillance and enforcement powers and duties of the Health and Safety Executive (“HSE”), in Great Britain, and the Health and Safety Executive for Northern Ireland (“HSE (NI)”), in Northern Ireland. This implements certain requirements of Chapter V of Regulation 2016/424/EU. The principal enforcement powers (Regulations 21 and 22) are derived from the Health and Safety at Work Act 1974 and the Health and Safety at Work (Northern Ireland) Order 1978. Regulation 20 designates HSE in Great Britain, and HSE (NI), in Northern Ireland as the market surveillance authority for the purposes of Regulation 2016/424/EU and Regulation <Citation URI="http://www.legislation.gov.uk/european/regulation/2008/0765" id="c00005" Class="EuropeanUnionRegulation" Year="2008" Number="765">(EC) 765/2008</Citation> of the European Parliament and of the Council of 9th July 2008 setting out requirements for accreditation and market surveillance relating to the marketing of products and repealing Regulation <Citation URI="http://www.legislation.gov.uk/european/regulation/19935/0339" id="c00006" Class="EuropeanEconomicCommunityRegulation" Year="19935" Number="339">(EEC) No 339/935</Citation> (O.J. No. L 218, 13.8.2998, p.30). Regulations 23 and 24 set out enforcement functions for HSE and HSE (NI) in relation to safety, components, subsystems and cableway installations which present safety risks and Regulation 25 sets out enforcement functions for HSE and HSE (NI) in the event of non-compliance with certain formal aspects of Regulation 2016/424/EU. Regulation 26 provides a defence of due diligence in respect of any proceedings arising under or by virtue of these Regulations.
