The Secretary of State for Education makes the following Order in exercise of the powers conferred by section 82(3) and (7) of the Education Act 20111.

Citation and commencement1.

(1)

This Order may be cited as the Education Act 2011 (Commencement No. 4 and Transitional and Savings Provisions) (Amendment) Order 2018.

(2)

This Order comes into force on 9th July 2018.

Revocation2.

Article 5 of the Education Act 2011 (Commencement No. 4 and Transitional and Savings Provisions) Order 20122 is revoked.

EXPLANATORY NOTE
(This note is not part of the Order)

This Order revokes article 5 of the Education Act 2011 (Commencement No. 4 and Transitional and Savings Provisions) Order 2012 (S.I. 2012/1087).

Article 5 related to the commencement of an amendment to section 19 of the Education Act 2002 (c. 32). It paused the effect of the amendment until the governing body or local authority of a maintained school decided to vary the instrument of government. Further to regulations 2(1) and (3) of the School Governance (Constitution and Federations) (England) (Amendment) Regulations (S.I. 2014/1257), no such transitional arrangement was to persist beyond 1 September 2015. The provision is therefore revoked.
