The Secretary of State makes these Regulations in exercise of the powers conferred by section 8(1) and paragraph 21 of Schedule 7 to the European Union (Withdrawal) Act 2018 F1.
The requirements of paragraph 3(2) of Schedule 7 to the Act (relating to the appropriate Parliamentary procedure for these Regulations) have been satisfied.
1. These Regulations may be cited as the Exotic Disease (Amendment) (England) (EU Exit) Regulations 2018 and come into force on exit day.

3.—(1) The Foot-and-Mouth Disease (Control of Vaccination) (England) Regulations 2006 F3 are amended as follows.
(2) In regulation 9(1)(c), at the end insert “ with the reference to “Member States” in paragraph 3.1 in Annex X being read as a reference to the Secretary of State ”.
(3) In regulation 28, for “another” substitute “ a ”.

(2) In regulation 9(5), omit the words from “approved” in the first place it occurs to the end.

6.—(1) The Avian Influenza (Vaccination) (England) Regulations 2006 F6 are amended as follows.
(2) In regulation 2, in paragraph (1)—
(a)in the definition of “emergency vaccination plan”, after “Article 53 of the Directive” insert—

These Regulations are made in exercise of the powers in the European Union (Withdrawal) Act 2018 (c.16) in order to address failures of EU-derived domestic legislation to operate effectively and other deficiencies (in particular, under section 8(2)(d) and (g) of that Act) arising from the withdrawal of the United Kingdom from the European Union. These Regulations make amendments to legislation in England in the field of exotic diseases in animals.
