The Feed-in Tariffs and Contracts for Difference (Amendment) (EU Exit) Regulations 2018

The Secretary of State makes these Regulations in exercise of the powers conferred by section 8(1) of European Union (Withdrawal) Act 20181.

The requirements of paragraph 3(2) of Schedule 7 to that Act (relating to the appropriate Parliamentary procedure for these Regulations) have been satisfied.

Citation and commencement1.

These Regulations may be cited as the Feed-in Tariffs and Contracts for Difference (Amendment) (EU Exit) Regulations 2018 and come into force on exit day.

Amendment of the Feed-in Tariffs Order 20122.

In article 27(6) of the Feed-in Tariffs Order 20122, in paragraph (b) of the definition of “qualifying renewable electricity”, omit “other than the United Kingdom”.

Amendment of the Electricity Supplier Obligations (Amendment & Excluded Electricity) Regulations 20153.

In regulation 3(3)(b) of the Electricity Supplier Obligations (Amendment & Excluded Electricity) Regulations 20153, omit “other than the United Kingdom”.

EXPLANATORY NOTE
(This note is not part of the Regulations)

These Regulations are made in exercise of the powers conferred by section 8(1) of the European Union (Withdrawal) Act 2018 (c. 16) in order to address failures of retained EU law to operate effectively and other deficiencies (in particular under section 8(2)(a) of that Act) arising from the withdrawal of the United Kingdom from the European Union.

These Regulations amend the Feed-in Tariffs Order 2012 and the Electricity Supplier Obligations (Amendment & Excluded Electricity) Regulations 2015, to reflect the fact that the United Kingdom will not be a member State of the EU following the United Kingdom’s withdrawal from the EU.

An impact assessment has not been produced for these Regulations as no impact on business or the public or voluntary sectors is foreseen.
