The Secretary of State for Health makes the following Order in exercise of powers conferred by sections 51 and 273(1) of, and paragraph 10 of Schedule 4 to, the National Health Service Act 2006(1).

Citation and commencement

1.  This Order may be cited as the National Health Service Trusts (Trust Funds: Appointment of Trustees) (Revocation) and the NHS Foundation Trusts (Trust Funds: Appointment of Trustees) (Amendment) Order 2017 and comes into force on 1st April 2017.

Revocations

2.  The instruments specified in the Schedule (which relate to the appointment of trustees for National Health Service trusts by the Secretary of State) are revoked.

Substitution of Schedule 1 to the NHS Foundation Trusts (Trust Funds: Appointment of Trustees) Order 2007

3.  For Schedule 1 to the NHS Foundation Trusts (Trust Funds: Appointment of Trustees) Order 2007(2) substitute—

EXPLANATORY NOTE

(This note is not part of the Order)

Article 2 of, and the Schedule to, this Order revoke six statutory instruments relating to the appointment of trustees for National Health Service trusts.

Article 3 of this Order substitutes Schedule 1 to the NHS Foundation Trusts (Trust Funds: Appointment of Trustees) Order 2007 (S.I. 2007/1766) to provide that the only NHS foundation trust for which the Secretary of State must appoint trustees is the University Hospitals Bristol NHS Foundation Trust.

An impact assessment has not been produced for this instrument as it has no impact on private or voluntary sectors.

2006 c.41. Section 51(4) is repealed by paragraph 7 of Schedule 14 to the Health and Social Care Act 2012 (c.7) (“the 2012 Act”) and section 51 is repealed by section 1(1)(a) of the NHS (Charitable Trusts Etc) Act 2016 (c.10), both from a date to be appointed. Paragraph 10 of Schedule 4 is repealed by virtue of the repeal of section 25 by section 179(2) of the 2012 Act from a date to be appointed.
