<Text>These Regulations apply in relation to local housing authorities in England only.</Text>

<Title>Interpretation</Title>

<Pnumber>2</Pnumber>
<P1para>
<Text>In these Regulations—</Text>
<UnorderedList Decoration="none" Class="Definition">
<ListItem>
<Para><Text>“the <Abbreviation Expansion="Housing Act 2004 c. 34">2004 Act</Abbreviation>” means the Housing Act 2004;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“the <Abbreviation Expansion="Rent Repayment Orders (Supplementary Provisions) (England) Regulations 2007 (S.I. 2007/572)">2007 Regulations</Abbreviation>” means the Rent Repayment Orders (Supplementary Provisions) (England) Regulations 2007<FootnoteRef Ref="f00003"/>;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“the <Abbreviation Expansion="Housing Act 2016 c. 22">2016 Act</Abbreviation>” means the Housing and Planning Act 2016;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“enforcement function” means, in relation to a local housing authority<FootnoteRef Ref="f00004"/>—</Text>
<OrderedList Decoration="parens" Type="alpha">
<ListItem>
<Para><Text>any of its functions—</Text><OrderedList Decoration="parens" Type="roman">
<ListItem>
<Para><Text>under Parts 1 to 4 of the 2004 Act; or</Text></Para>
</ListItem>
<ListItem>
<Para><Text>under Part 2 of the 2016 Act; or</Text></Para>
</ListItem>
</OrderedList>
</Para>
</ListItem>
<ListItem>
<Para><Text>where paragraph (a) does not apply, any of its functions, conferred on it as local housing authority—</Text><OrderedList Decoration="parens" Type="roman">
<ListItem>
<Para><Text>connected with an investigation of, or proceedings relating to, a contravention of the law relating to housing or landlord and tenant; or</Text></Para>
</ListItem>
<ListItem>
<Para><Text>connected with the promotion of compliance with the law relating to housing or landlord and tenant; and</Text></Para>
</ListItem>

</Para>
</ListItem>
</OrderedList>
</Para>
</ListItem>
<ListItem>
<Para><Text>“private rented sector” means—</Text>
<OrderedList Decoration="parens" Type="alpha">
<ListItem>
<Para><Text>a landlord under a tenancy of residential premises in England that is not a registered provider of social housing<FootnoteRef Ref="f00005"/>;</Text></Para>
</ListItem>
<ListItem>
<Para><Text>residential premises in England that are let, or intended to be let, under a tenancy by a landlord that is not a registered provider of social housing;</Text></Para>
</ListItem>
<ListItem>
<Para><Text>common parts of such premises;</Text></Para>
</ListItem>
<ListItem>
<Para><Text>English letting agency work within the meaning of section 54 of the 2016 Act in relation to such premises; or</Text></Para>
</ListItem>
<ListItem>
<Para><Text>English property management work within the meaning of section 55 of the 2016 Act in relation to such premises;</Text></Para>
</ListItem>
</OrderedList>
<Text>and for the purpose of this definition “residential premises” has the meaning given by section 1 of the 2004 Act.</Text>

<P2para><Text>A local housing authority may apply any amount recovered under a rent repayment order under Chapter 4 of Part 2 of the 2016 Act to meet the costs and expenses (whether administrative or legal) incurred in, or associated with, carrying out any of its enforcement functions in relation to the private rented sector.</Text>

<P><Text>Regulation 5 makes provision in relation to rent repayment orders made under sections 73 and 96 of the 2004 Act by amending the Rent Repayment Orders (Supplementary Provisions) (England) Regulations 2007 (<Citation URI="http://www.legislation.gov.uk/id/uksi/2007/572" id="c00003" Class="UnitedKingdomStatutoryInstrument" Year="2007" Number="0572">S.I. 2007/572</Citation>).</Text></P>
<P><Text>A full regulatory impact assessment has not been prepared for this instrument as no impact on business or the private or voluntary sector is foreseen where those organisations are compliant with the relevant legislation.</Text></P>
