The National Health Service Commissioning Board and Clinical Commissioning Groups (Responsibilities and Standing Rules) (Amendment) Regulations 2017

Coming into force
The Secretary of State for Health makes the following Regulations in exercise of the powers conferred by sections 3B(1) and 272(7)(a) and (b) of the National Health Service Act 20061.

In accordance with section 3B(4) of that Act, the Secretary of State obtained appropriate advice and consulted the National Health Service Commissioning Board before deciding to make these Regulations.

Citation and commencement1.

These Regulations may be cited as the National Health Service Commissioning Board and Clinical Commissioning Groups (Responsibilities and Standing Rules) (Amendment) Regulations 2017 and come into force on 1st April 2017.

Further service to be commissioned by the Board2.

Schedule 4 (services for rare and very rare conditions) to the National Health Service Commissioning Board and Clinical Commissioning Groups (Responsibilities and Standing Rules) Regulations 20122 is amended as follows.

After paragraph 140A, insert—

“140B.

Uterine transplantation services.”.

EXPLANATORY NOTE
(This note is not part of the Regulations)

These Regulations amend Schedule 4 to the National Health Service Commissioning Board and Clinical Commissioning Groups (Responsibilities and Standing Rules) Regulations 2012 (S.I. 2012/2996) (“the principal Regulations”). Schedule 4 to the principal Regulations specifies services for rare and very rare conditions which the National Health Service Commissioning Board (“the Board”) must arrange for the provision of, as part of the health service.

Regulation 2 amends Schedule 4 to give effect to the revised commissioning responsibilities for the Board pursuant to regulations 7, 10 and 11 of the principal Regulations.

This amendment follows advice received, and consultation with the Board, pursuant to the statutory procedures set out in section 3B(4) of the National Health Service Act 2006.

No impact assessment has been produced for these Regulations as they have no impact on the private sector and civil society organisations, and no significant effect on the public sector.
