The Social Security (Social Care Wales) (Amendment) Regulations 2017

The Secretary of State for Work and Pensions makes the following Regulations in exercise of the powers conferred by sections 6H(5) and 36(4)(a) of the Jobseekers Act 1995(1), sections 11H(5) and 25(5)(a) of the Welfare Reform Act 2007(2) and sections 24(5) and 42(3)(a) of the Welfare Reform Act 2012(3).

In accordance with section 173(1)(b) of the Social Security Administration Act 1992(4), the Social Security Advisory Committee has agreed that the proposals in respect of these Regulations should not be referred to it.

Citation and commencement

1.  These Regulations may be cited as the Social Security (Social Care Wales) (Amendment) Regulations 2017 and come into force on 1st April 2017.

Amendment of the Universal Credit Regulations 2013

2.  In paragraph (4) of regulation 98 of the Universal Credit Regulations 2013(5) (victims of domestic violence) for paragraph (b) of the definition of “registered social worker” substitute—

(b)Social Care Wales;.

Amendment of the Jobseeker’s Allowance Regulations 2013

3.  In paragraph (5) of regulation 15 of the Jobseeker’s Allowance Regulations 2013(6) (victims of domestic violence) for paragraph (b) of the definition of “registered social worker” substitute—

(b)Social Care Wales;.

Amendment of the Employment and Support Allowance Regulations 2013

4.  In paragraph (5) of regulation 49 of the Employment and Support Allowance Regulations 2013(7) (victims of domestic violence) for paragraph (b) of the definition of “registered social worker” substitute—

(b)Social Care Wales;.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Universal Credit Regulations 2013 (S.I.2013/376), the Jobseeker’s Allowance Regulations 2013 (S.I.2013/378) and the Employment and Support Allowance Regulations 2013 (S.I.2013/379).

In particular, these Regulations amend the definition of “registered social worker” in each of those Regulations to reflect the renaming, by Part 3 of the Regulation and Inspection of Social Care (Wales) Act 2016 (anaw 2), of the Care Council for Wales as Social Care Wales. That definition relates to who is deemed to be a person acting in an official capacity who can provide evidence that domestic violence has been inflicted or threatened against a claimant for those benefits.

An impact assessment has not been produced for this instrument as it has no impact on business or civil society organisations.
