The International Headquarters and Defence Organisations (Designation and Privileges) Order 2017

Present,
The Queen’s Most Excellent Majesty in Council
Her Majesty, on the advice of Her Privy Council and in exercise of the power conferred on Her by section 1 of the International Headquarters and Defence Organisations Act 1964, makes the following Order:
Citation and commencement1.
This Order may be cited as the International Headquarters and Defence Organisations (Designation and Privileges) Order 2017 and shall come into force on the day after that on which it is made.
Designation of headquarters2.
The international headquarters and defence organisations specified in the Schedule to this Order are hereby designated for the purposes of the International Headquarters and Defence Organisations Act 1964.
Inviolability of archives3.
The headquarters and organisations specified in the Schedule to this Order shall have the like privileges as respects inviolability of official archives as are accorded to an envoy of a foreign sovereign power accredited to Her Majesty.
Legal capacity4.
Each of the headquarters specified in Part I of the Schedule to this Order shall have the legal capacity of a body corporate.
Extent of immunity from legal process5.
(1)
Each of the headquarters specified in Part I of the Schedule to this Order shall have immunity from any legal process subjecting any funds or other property belonging to it or under its control to any measure of execution or detention.
(2)
The preceding paragraph shall not prevent—
(a)
the seizure of any article connected with an offence; or
(b)
the seizure of any article under the laws relating to customs or excise.

This Order replaces the International Headquarters and Defence Organisations (Designation and Privileges) Order 1965 (“the 1965 Order”) which was amended on four occasions. The 1965 Order listed those headquarters which were designated for the purposes of the International Headquarters and Defence Organisations Act 1964.
To reflect the changes to the NATO command and force structure, two headquarters are renamed from Part II of the Schedule to the 1965 Order, namely:
Maritime Component Command Headquarters Northwood (CC-MAR HQ NORTHWOOD) as Allied Maritime Command (MARCOM).
The Intelligence Fusion Centre (IFC) as The NATO Intelligence Fusion Centre (NIFC)
Seven headquarters remain unchanged:

NATO Airborne Early Warning and Control Force (NAEW&CF)
NATO Joint Electronic Warfare Core Staff (NATO JEWCS)

Two headquarters are new, having been set up since the last amendment to the 1965 Order:
NATO Centralised Targeting Capacity (CTC)
1st NATO Signal Battalion, NATO CIS Group (1 NSB, NCISG)
