4. In section 42A (power to make orders delegating functions)(1), after subsection (7), insert—
“(7A) Subsection (7) does not apply to a reference in paragraph 20A of Schedule 3 to the Secretary of State or the Welsh Ministers.”
Section 42A was inserted in relation to England and Wales by paragraph 3(1) of Schedule 21 to the Marine and Coastal Access Act 2009 (c. 23).
