Nature conservation bodies5
1
Except as provided by paragraphs (2) to (4), in these Regulations—
a
“nature conservation body” means Natural England or the Natural Resources Body for Wales; and
b
“the appropriate nature conservation body” means—
i
Natural England, in relation to England; or
ii
the Natural Resources Body for Wales, in relation to Wales.

In regulations 50 and 52, “nature conservation body” means Natural England, the Natural Resources Body for Wales or the Joint Nature Conservation Committee M1.

In a provision of Part 6 which extends to England and Wales only, “the appropriate nature conservation body” means—
a
in relation to an effect on a European offshore marine site, the Joint Nature Conservation Committee; and
b
otherwise—
i
in relation to England, Natural England; and
ii
in relation to Wales, the Natural Resources Body for Wales.

In a provision of Part 6 which extends to Scotland or Northern Ireland, “the appropriate nature conservation body” means—
a
in relation to an effect on a European offshore marine site, the Joint Nature Conservation Committee; and
b
otherwise—
i
in relation to England, Natural England;
ii
in relation to Wales, the Natural Resources Body for Wales;
iii
in relation to Scotland, Scottish Natural Heritage; and
iv
in relation to Northern Ireland, the Department of Agriculture, Environment and Rural Affairs.
