http://www.legislation.gov.uk/uksi/2016/987/article/7The Brechfa Forest Wind Farm Connection Order 2016enINFRASTRUCTURE PLANNINGStatute Law Database2025-09-04Expert Participation2017-03-10 This Order authorises Western Power Distribution (South Wales) Plc (referred to in this Order as the undertaker) to construct and maintain a 132kV above ground electric line approximately 28.6km long in Carmarthenshire, Wales. The electric line runs from a new substation serving the Brechfa Forest West Wind Farm to the existing Swansea 132kV above ground electric line and includes a section of approximately 3.56km of undergrounding. The Order permits the undertaker to acquire, compulsorily or by agreement, rights in land and to use land for this purpose. A copy of the plans and book of reference referred to in this Order and certified in accordance with article 33 (certification of plans) of this Order may be inspected free of charge at Carmarthenshire County Borough Council of County Hall, Carmarthen SA31 1JP. PART 2 7 1 The undertaker may, with the consent of the Secretary of State— a transfer to another person (the “transferee”) any or all of the benefit of the provisions of this Order and such related statutory rights as may be agreed between the undertaker and the transferee; or b grant to another person (“the lessee”) for a period agreed between the undertaker and the lessee, any or all of the benefit of the provisions of this Order and such related statutory rights as may be so agreed. 2 Where a transfer or grant has been made in accordance with paragraph (1) references in this Order to the undertaker, except in paragraph (3), shall include references to the transferee or the lessee. 3 The exercise by a person of any benefits or rights conferred in accordance with any transfer or grant under paragraph (1) is to be subject to the same restrictions, liabilities and obligations as would apply under this Order if those benefits or rights were exercised by the undertaker.
